MR. TRULSON: Mr. Chairman. Could we have a <br /> five minute recess, please? <br /> RECESS: At 3 :50 p.m. the Chair called for a short recess. <br /> RECONVENE: At 4: 11 p.m. the meeting was reconvened. <br /> MR. ODA: I would ask the commission for <br /> whenever changes are required, as Mr. Ishida calls it, for <br /> ministerial functions, just to conform to language, that I <br /> would like to have some kind of authority from the commission <br /> to make the necessary changes in language, not in substance, <br /> but in form, to conform to make it consistent. <br /> MR. SCHUTTE: I think we have already given <br /> that authority to counsel at the last meeting. <br /> MR. ODA: Did you? Last meeting? <br /> SECTION 9-4: MR. SCHUTTE: There was a suggestion in sub- <br /> section (d) and (e) that the word /magistrates7 <br /> be changed to judges. There are two in (d) and <br /> one in (e) . My question is that they all be <br /> changed from magistrates to judges. <br /> CHAIRMAN SAKATA: It has been moved .that the <br /> word magistrates in subsection (d) and (e) be changed to judges <br /> in Section 9-4. <br /> MR. SCHUTTE: With regard to Section 9-4, Powers, <br /> Duties and Functions, I move that the Section be adopted it is <br /> amended and that counsel make the necessary corrections in the <br /> language. <br /> MR. TRULSON: Second. <br /> CHAIRMAN SAKATA: It has been moved and seconded <br /> that we adopt Section 9-4, Powers, Duties and Functions of the <br /> Prosecuting Attorney by amending the language to judges instead <br /> of magistrates in subsections (d) and (e) . <br /> MR. TRULSON: Commissioner Schutte, your motion <br /> is on all of the Section 9-4? <br /> MR. SCHUTTE: That is correct. All of Section <br /> 9-4. Giving counsel the authority to make the necessary <br /> corrections. <br /> MR. TRULSON: Mr. Ono has asked for one other <br /> change which is purely a housekeeping change.,. which he would <br /> like to call. subsection. (f) . That is._ _to. . .-( f:) . . .Investigate <br /> all matters which may properly come before him. <br /> He states, in his testimony, which would simply <br /> state that again this is simply a housekeeping type of addition <br /> -20- <br />
