KOBAYASHI : Second. <br /> CHAIRMAN SAKATA: It has been moved and seconded <br /> that we adopt Section 9-5 , 9-6, and 9-7 as amended and 9-5 <br /> with the present paragraph designated as subsection ( a) and <br /> a new subsection (b) added. <br /> MR. SCHUTTE: Excuse me. Richard, Section 9-5 , <br /> you are adding another subsection to 9-5? <br /> MR. ISHIDA: Right. <br /> MR. SCHUTTE: That would be subsection (b) . <br /> MR. ISHIDA: No. The present paragraph would be <br /> subsection ( a) and there will be a new subsection (b) which I <br /> just read. <br /> MR. SCHUTTE: Wouldyou read that again. <br /> MR. ISHIDA: That is the one. . .The prosecuting <br /> attorney may appoint investigators who shall have all the powers <br /> and privileges of a police of the county. <br /> In support of my motion, I would just like to <br /> state that the prosecuting attorney did make this request and <br /> I feel that in order for his office to work more efficiently, <br /> :granting this authority to the office of the prosecuting <br /> attorney does not in any way allow him to be able to abuse <br /> that power, in my estimation. The charter just grants him this <br /> authority in there and if there are any other stricter require- <br /> ments that need necessarily be made as far as the investigator <br /> to be appointed, of course, that can be done by the council. <br /> MR. TRULSON: Mr. Chairman. Mr. Ono states in <br /> his testimony that this is already being done anyway and also <br /> is provided for in Section 62-78 of the Hawaii Revised Statutes. <br /> It simply states that the county attorney may appoint an <br /> investigator who shall have the powers and privileges of a <br /> police officer of the county. He say „ we_already have a <br /> special investigator that is on the staff, again, this would <br /> just clarify what is already being done. <br /> MR. ISHIDA: Then what were-we arguing about? <br /> MR. OMONAKA: If it is there, we don ' t need an <br /> addition, an amendment. <br /> MR. SCHUTTE: May I make a comment on this? <br /> On this particular section that says the prosecutor may appoint <br /> investigators who shall have all the powers and privileges of <br /> a police officer of the county, you know, this gives him that <br /> supreme authority to do exactly that. It doesn 't necessarily <br /> say that any individual has to be a qualified police officer, <br /> or a qualified investigator. I think if you recall a year or <br /> two ago there was an individual---this is in regards to a case <br /> in Honolulu where an individual was appointed to the prosecutor' s <br /> staff as an investigator and if_I"..__am- not mistaken,- he -was <br /> -22- <br />
