TRULSON: Second. <br /> CHAIRMAN SCHUTTE : It has been moved and seconded <br /> that Section 5-2.6 be adopted. Term of Office. . .The term of <br /> office of the corporation counsel, assistant _. corporation and <br /> deputies shall be co-terminous with that of the mayor; <br /> provided that where a successor has not been appointed and <br /> confirmed, the corporation counsel shall continue in office <br /> pending such appointment and confirmation, but in no event <br /> shall he continue in office beyond three months, whether <br /> acting or otherwise. <br /> MR. ISHIDA: After assistant corporation we should <br /> add the word "counsel". . .assistant corporation counsel. <br /> CHAIRMAN SCHUTTE: The intent of this motion of <br /> this section is to prevent a temporary employee from holding <br /> office for more than three months. Any discussion on the <br /> motion? <br /> MR. OMONAKA: What is the difference between the <br /> corp counsel and the other department heads that require <br /> confirmation? <br /> MR. ISHIDA: The removal of other department heads , <br /> they do not require council approval. <br /> CHAIRMAN SCHUTTE : Any further discussion? <br /> MR. OMONAKA: Mr. Chairman. Mr. Ishida, as the <br /> language now, that is prepared, is an automatic out of <br /> office for the corporation counsel as soon as the mayor ' s <br /> term expires? <br /> MR. ISHIDA: Right. Except he can stay there an <br /> additional three months. <br /> MR. OMONAKA: And the mayor would have to re-submit <br /> his name or another name. But the intent is there that even <br /> if the mayor wins another election, it ' s. . . <br /> MR. ISHIDA: Yes, he has to re-submit his name, <br /> right. <br /> MR. ODA: In the present situation, Mr. Omonaka, <br /> theoretically, there could be an acting corporation counsel <br /> for four years. <br /> MR. ISHIDA: The only thing I think is since we <br /> are making him accountable to the mayor and the council , I <br /> don ' t think he should be left there if one of the bodies <br /> don ' t really want him. <br /> -26- <br />
