MR. TRULSON: Say this is put_onthe ballot. <br /> (presentation on chalkboard) Okay? One of the four can win. <br /> If they say 17 2 , and 3--say, 3 comes out with a plurality. <br /> Not a majority, but a plurality. Do you think it could be <br /> successfully challenged and defeated? <br /> MR. ODA: I have some concerns about doing <br /> something like that. First of all , it ' s the fact that you <br /> don ' t have status quo. . . <br /> MR. TRULSON: What if there was just an <br /> additional sentence? <br /> MR. ODA: Well , if you put. . . are you in favor <br /> of the status quo?. . .what you are,, in fact , doing is-- <br /> supposing the status quo itself doesn ' t pass by a majority? <br /> Then what happens if none of these get a majority? None of <br /> the four? <br /> MR. TRULSON : How about a sentence that states <br /> if none of these three get a majority, then it remains status <br /> quo? If none of the three receive a majority of the votes , <br /> the council makeup would remain as is? <br /> MR. ODA: You can do that, I suppose. . .but, <br /> anytime you have more than two options , the chances of any <br /> option getting the majority are extremely rare because you're <br /> going to vote for only one. . . <br /> MR. TRULSON: That 's what I 'm saying. If the <br /> voters know that the majority, not a plurality, a majority, <br /> or 50. 1%, do not vote for #1 , #2, or #3 , the status quo is the <br /> same. That can be part of our job as far as voter education <br /> is concerned. Now, the proponents of either one of those are <br /> going to have to do their homework and whichever side prevails, <br /> fine. The voters have their three choices. They understand <br /> that if 50. 1% don 't vote for #1 , #2, or #3 , the status quo <br /> remains as is. <br /> MR. ODA: That can be done but we simply cannot <br /> put option #4, as status quo. . . <br /> MR. TRULSON: That ' s what I 'm saying. That <br /> would eliminate that. <br /> MR. ODA: What you would , in fact, be doing if <br /> you list it, or even if you don ' t list it, you are, in fact, <br /> stacking it in favor of status quo because you have three options. <br /> It would be a built-in bias for status quo. But, if that ' s what <br /> the commission wants , that ' s what the commission will receive. <br /> MR. TRULSON: The commission , I don ' t believe, <br /> can make a decision on this. It ' s already been voted that it <br /> is deferred. So, it ' s really discussion. <br /> MR. ODA: Possibly, say, the commission votes to <br /> say that any option above does not obtain 51%, or more, of the <br /> votes cast, would result in status quo. It can be done. . . <br /> -10- <br />
