OMONAKA: I would like to recommend <br /> 90 days prior to the close of nominations for filing a <br /> petition for election. <br /> MRS. KOBAYASHI : How would you take care of <br /> the apportionment commission ' s decision? <br /> MR. OMONAKA: The guy has got to make up his <br /> mind. He has so many days. He has got to move or stay <br /> there. At least, it gives him time. <br /> MR. ODA: What if we word it in such a way. . <br /> 6 months or 90 days immediately preceding the primary <br /> election or his appointment, to cover appointments for <br /> vacancies. That is why they have the word appointment there. <br /> CHAIRMAN SAKATA: So, if he does leave his <br /> district then that automatically becomes a vacant seat, <br /> right? <br /> MR. ODA: Yes. Rudy, how many months before <br /> the primary election are the nominations closed? <br /> MR. LEGASPI : 90 days. I can check on that <br /> for sure. <br /> MR. ODA: 90 days. <br /> MR. LEGASPI : I was just curious to listen to <br /> your discussion on this, Mr. Chairman. I think if you don ' t <br /> set it at a year ;y-ou_ _ _ would be in violation of the HRS. <br /> I think if the charter does not spell out the residency <br /> requirement for a year you will be in violation. That ' s <br /> 62-3, Stuart, on that. <br /> Section 62-3 ". . .Has been a duly qualified <br /> elector of the State and of the County in which he is elected <br /> for at least one year next prior to his election. . . " <br /> So there is a residency requirement already <br /> imposed by the state. , <br /> MR. OMONAKA: But, that is for state office, <br /> or? <br /> MR. LEGASPI : No. Local office. Again, this <br /> is written up in my recommendations. It think it is <br /> identified as Communication #17. What we were recommending <br /> at that time was that for the three different types of <br /> elections.. . For the mayor, prosecuting attorney, and the <br /> council to conform to the State Statute, wasjust one year. <br /> We recommended that in Communication #17. <br /> MR. ODA: What about residency in the district? <br /> -4- <br />
