<br /> <br /> <br /> Ms. Wong: Yeah, I spoke to Mr. Olson before we started. The agenda item was put <br />forth before—we had two recent developments since the lawsuit was filed. It’s public <br />information now with respect to the EPA consent decree and the timelines being extended. <br />So I proposed that if you have specific questions about the actual lawsuit that’s been filed- <br />-although the County is not a party to it, we could be brought in at some point, so I just <br />want to preserve the County’s position with respect to any allegations of the lawsuit. If <br />you want to talk about that specifically, then I recommend we convene in executive <br />session. But with respect to the process and the timelines and the status of the treatment <br />plant, a lot of that is public information, so I don’t think it’s appropriate to go into <br />executive session. But I’ll just be listening closely, and if I feel like we’re king of getting— <br /> <br /> Chair Bennett: --There was a comment made that because there is a lawsuit filed, <br />we should not be talking about the waste treatment plant in Nāālehu at all.ʻ <br /> <br /> Ms. Wong: Well, we’re not a party to that lawsuit. There’s a fine line—but that’s <br />why I say, if you have specific questions about the lawsuit and the allegations and the <br />County’s involvement, I want to be able to preserve our position should we be brought into <br />that lawsuit, so then we could go into executive session. But I think what the intent of the <br />discussion was to have an update about the status, the timeline, which is public <br />information now. So it would not be appropriate for us to go into executive session for <br />that. <br /> <br /> Commissioner Fritz: It was me that brought this up, because this woman has come <br />here many, many times. This man has been coming here for years. And then to see that <br />it’s gone so far as to show pictures of it next to an elementary school, it makes it seem like <br />it’s already been approved and it’s a done deal. I feel sorry for these people that live there <br />and have been told so many things that haven’t been true. So I just wanted to get the <br />truth out here of what’s going on there, and that’s my reason for wanting to discuss this. I <br />didn’t think it would be in executive session. I thought it would just be an agenda item <br />that we discussed amongst ourselves, because again, these citizens have taken time, and <br />this woman here has expended a lot of money on ink and paper. I think we owe it to them <br />to say, hey yeah, we hear your problems, we feel your pain, and we want to help you. At <br />least that’s my feeling. I don’t know how everyone else feels. But where are we going with <br />this? <br /> <br /> Chair Bennett: Ok, I was concerned, from the information I got, that we can’t <br />discuss it at all because it’s in litigation. But the County is not a litigant, so we are free to <br />discuss it. <br /> <br /> Commissioner Osborne: So can we discuss it? <br /> <br /> Ms. Wong: Yes, but if you have specific questions about what’s alleged in the <br />lawsuit, should the County be brought in, I want to be able to preserve our position in that <br /> <br /> <br />
