Charter Commission -1 July 13, 2018 <br />Okay, next. Executive meetings. Closed to the public, motion shall state the <br />reason for the closed meeting, requires two-thirds vote of the members present. <br />CHR. ADAMS: If I could—Chair Adams. I don't anticipate a lot of those, to be <br />honest with you. This is the people's business and so, it's much like making <br />sausage, will be making sausage in the open. <br />MR. YOSHIMOTO: Okay. <br />MR. HENRICKS: And if you wouldn't mind, if I could comment as well. Since <br />you brought that forward, this is Mr. Henricks. Closed meetings of this type are <br />not because—are not allowed because what somebody wants to say, they'd like to <br />keep secret. It has to be for a valid reason that there's potential harm to the <br />process with the County, not because, as you said, you'd prefer to say things in <br />confidence and keep it that way. And the other thing about any executive meeting <br />is that should it ever occur, to just understand that at some point in time, it's likely <br />that whatever you say will be made public. That at some point when the matter <br />becomes decided and there is no more liability that the minutes will be made <br />public. So, just because we're in a closed session, doesn't mean that we really <br />change our decorum in any way. Thank you. <br />MR. YOSHIMOTO: Okay. So, as Jon mentioned, in order to authorize executive <br />session, it needs to be for specified purposes. You can't just go and just because <br />you want to talk story about something. It's for specified reasons. So, one of <br />them are personnel decisions. Another reason is to consult with the board's <br />attorney. The next reason is to investigate criminal misconduct or matters <br />confidential by law or court order. <br />Meeting by interactive conference technology. This may come up during our <br />meetings, if we decided to have meeting through videoconference, which we have <br />the capability to the West Hawai`i Civic Center and vice versa, through Hilo and <br />other sites. Notice must identify locations where the board members will be <br />physically present. The public must be able to attend any of those locations, and <br />the meeting will end if audio interaction is not maintained with all locations. <br />That's per State law. <br />Testimony. All interested persons may submit written and/or oral testimony on <br />any agenda item. A board may adopt a rule setting reasonable time limit for <br />testimony. Members will note that currently, our rules provide for three minutes <br />for public testimony. There may be times when that rule may need to be adjusted. <br />Chair has the discretion to adjust it if so needed. <br />Okay, meeting agenda. Must list all items that the board intends to consider. <br />Must be sufficiently detailed so as to provide the public with adequate notice of <br />the matters to be considered. <br />Page 24 <br />
