Because all <br />you're doing there is hearing a case and then making a recommendation. I just <br />want to clarify that because I haven't made a determination whether I'm going to <br />do that, but I want to be real clear that does not pose a conflict if I were to get on <br />the list of potential hearing's officers for the County. <br />MR. YOSHIMOTO: Okay, we can talk further, offline, after the training, but I <br />believe there's an exception in the Code that allows you to act in a capacity where <br />the County is requesting your assistance. So, I'm going to look for that right now. <br />CHR. ADAMS: While Counsel looks for that, my memory is that's accurate. <br />Typically, this refers to from somebody else outside the County. But, the County <br />gets the option to do that or not. But, I'll let Counsel make the final determination <br />there. <br />MS. LEITHEAD TODD: If you could get back to me on that because I don't <br />want to end up inadvertently. I don't believe it is a violation and—but, you know, <br />if there is a need and—because the O`ahu attorneys have been unwilling to come <br />over because they end up losing money at the rate the County pays them. Thank <br />you. <br />MR. YOSHIMOTO: Okay, I will. Thank you, Commissioner Todd. Alright, <br />where were we? <br />CHR. ADAMS: You're looking at County Code of Ethics. <br />MR. YOSHIMOTO: Okay, Fair Treatment. These are just some of the <br />provisions—one thing to keep in mind, commission members, is that today's <br />overview is simply that. There's a lot of details to the Code of Ethics, as <br />Chair Adams will recall. Anyway, if anything should come up, please ask me the <br />questions directly and we can address them as they go along. <br />Fair Treatment. Officers and employees of the County, while discharging their <br />duties and dealing with the public, shall adhere to the following precepts: all <br />public property and equipment are to be treated as a public trust and are not to be <br />used in a proprietary manner or for personal purposes without proper consent. So, <br />I don't see that as an issue here. Basically, yeah, I don't see that being any kind <br />of issue here. <br />No person in a supervisory capacity shall engage in personal or business <br />relationships with subordinates, which might intimidate said subordinates in the <br />discharge of their official duties. I don't, again, see that as an issue here. <br />Number (3), all persons shall be treated in a courteous, fair, and impartial manner. <br />So, this one here has been the subject of many petitions as Chair Adams can attest <br />Page 27 <br />
