We can always talk story. Attorney- <br />client privilege and we'll address it appropriately. <br />Chair Adams is correct. Sometimes, these issues may not be readily apparent, but <br />again, by all means, just ask the question because we want to be preemptive and <br />avoid any problems that may occur. <br />Okay, Gifts. This is an important section in our County Code. No officer or <br />employee shall solicit, accept, or receive, directly or indirectly, any gift, whether <br />in the form of money, service, loan, travel, entertainment, hospitality, thing, or <br />promise or in any other form, under circumstances in which it can reasonably be <br />inferred—she needs water? Okay. We can wait. <br />MR. HOPKINS: Excuse me, I'm sorry. I had a question back on the other one. <br />MR. YOSHIMOTO: Go ahead. Which one? <br />MR. HOPKINS: How do we deal with issues such as, well, I'll just bring it up <br />right there. The issue of are we <br />going to put in something in the Charter to deal with the disaster losses and <br />helping people on that? What happens if we, as in my case, we lost two farms on <br />the thing. Do we recuse ourselves from the issue of discussing that topic? <br />Because we were already, I won't say we were directed, but it was mentioned as a <br />possible, do we recuse ourselves from that issue, or do we just disclose it? <br />MR. YOSHIMOTO: I—go ahead. Are you— <br />MR. HOPKINS: Recuse or disclose, that's the question. <br />MR. YOSHIMOTO: Recommendation moving forward would be to seek an <br />opinion from the Board of Ethics, basically, to just state forward all the facts and <br />circumstances and then ask for the Board's opinion as to what the advice the <br />Board can give you. Because the Board of Ethics is authorized to provide <br />opinions that are binding, that are valid. They'll help you decide what course of <br />action you should take. <br />CHR. ADAMS: Chair Adams, so we don't have the authority within our own <br />rules to consider that? <br />MR. YOSHIMOTO: In terms of the conflict? <br />CHR. ADAMS: Yeah, in other words, in terms of the discussion about whether <br />or not somebody should recuse themselves based on their view of that. <br />Page 32 <br />
