S UBDIVISIONS § 23-1 <br />CHAPTER 23 <br />SUBDIVISIONS <br />Article 1. General Provisions. <br />Section 23-1. Title. <br />This chapter may be cited as the subdivision control code. <br />(1983 CC, c 23, art 1, sec 23-1.)23-1 <br />Section 23-2. Scope of chapter. <br />As authorized by section 62-34(7),* Hawai‘i Revised Statutes, as amended, and <br />applicable ordinances, all subdivision plats and all streets or ways within the County <br />created for the purpose of partitioning land shall be approved by the director in <br />accordance with this chapter. <br />(1983 CC, c 23, art 1, sec 23-2.)23-2 <br />* Editor’s Note: Chapter 62, Hawai‘i Revised Statutes was repealed and replaced with chapter 46. <br />Section 23-3. Definitions. <br />Whenever used in this chapter, the following words and phrases, unless the context <br />otherwise requires, shall be defined as indicated: <br />(1) “Alley” means a narrow street through a block primarily for access by service <br />vehicles to the back or side of properties fronting on another street. <br />(2) “Arterial” means a street of considerable continuity, which is primarily a <br />traffic artery for intercommunication between or through large areas. <br />(3) “Building line” means a line on a plat indicating the limit beyond which <br />buildings or structures may not be erected. <br />(4) “Bureau of conveyances” means a bureau in the department of land and <br />natural resources, State of Hawai‘i, where subdivisions meeting the <br />requirements of this chapter may be filed. <br />(5) “City of Hilo” means that portion of the district of South Hilo, County of <br />Hawai‘i, which is described as follows: Bounded on the south by the district of <br />Puna; bounded <br />north by the ahupua‘a of Paukaa in the district of South Hilo; and on the east <br />by the sea. <br />(6) “Conforming” means compliance with the requirements of the applicable <br />zoning district, including minimum building site area and minimum <br />dimensions. <br />(7) “Consolidation” means the combining of two or more lots into one lot. <br />(8) “County general plan” means the plan adopted by the County for the guidance <br />of growth and improvement of the County, including modifications or <br />refinements which may be made from time to time. <br />23-1 <br /> <br />
