Charter Cortunission-1 July 13, 2018 <br />agencies that have the power to review the actions of the agency on which the <br />officer serves, or to act on the same subject matter as the agency on which the <br />officer serves. So, that's a long sentence, but I think it's self-explanatory. Chair <br />Adams, did you have any— <br />CHR. ADAMS: I was just going to say that the key here is if you are representing <br />anyone or organization before any of the commissions, boards, or Council of the <br />County, then this is where this pertains. So, just be aware that there's a section <br />that is in the County Code and we don't want to necessarily be on the wrong we <br />don't want to be on the wrong side of this, right? So, this does not prevent you, <br />correct me if I'm wrong here, Counsel, this does not prevent you, for example, <br />from going before the Council or going before another body, not this one, <br />obviously, and representing your own interest or providing testimony on an item <br />that they have, correct? This does not prevent them from doing that. <br />MR. YOSHIMOTO: Correct. <br />CHR. ADAMS: Right. So, you can do those kinds of things. It's the other one <br />when you're representing somebody else, kind of ideas where this comes into— <br />MR. YOSHIMOTO: Okay, thank you. And (f) accept a retainer, compensation <br />or election campaign contribution that is contingent upon action by a county <br />agency. That shouldn't be applicable to board members here. <br />Okay, Hawaii County Code of Ethics. Article 15, Hawaii County Code. Our <br />Code of Ethics applies to all County officers and employees. All officers and <br />employees are presumed to know the requirements of the ethics code. The Code <br />is interpreted by the Board of Ethics, and citizens and employees may file <br />petitions. <br />MS. LEITHEAD TODD: Mr. Yoshimoto? <br />MR. YOSHIMOTO: Yes. <br />MS. LE1THEAD TODD: Item (f), and the reason I ask is I have not done so, but <br />I have been asked to sign up to be on the list of potential hearings officers for the <br />Planning Department because they've been having difficulty in the past getting <br />qualified attorneys with the expertise in land -use law at the amount that they're <br />willing to pay those attorneys. So, the definition of contingent upon action means <br />that I would get compensation and I would only get paid if somebody was <br />approving something as opposed to being hired by the County to do something <br />Page 26 <br />
