Mr. Goodenow: <br />Right...when you read it in connection with that it...there... is <br />clear that people can be hired post -employment right that so the <br />correct interpretation would be that the 2-85 really refers to <br />contracts for goods and services and is separate from employment. <br />Any comment on that particular point anyone? Mr. <br />Yoshimoto...we're okay? <br />Mr. Yoshimoto: Yes. <br />Mr. Goodenow: <br />Ms. Sumner -Mack: <br />Mr. Goodenow: <br />Thank you and I guess as far as 2-83 which is finding that while <br />there has been some evidence do we want to say irregularities or it <br />doesn't necessarily provide sufficient evidence to show that the <br />department, the Mayor's Office, or whatever. With whatever...all <br />the parties specifically violated the fair treatment provision...is <br />that sufficient? <br />I wonder if we can instead of saying we have found...we could say <br />it appears from what we've heard today that there was no violation <br />of the Code of Ethics...just that it appears. I think we ought to say <br />something thoughtful about sole source contracts...which Mr. <br />Wiseman pointed out...seems to be the classification for this <br />contract...and so we need to caution that a sole source contract <br />needs to have a sufficient and documented rational...in detail from <br />those and that's all. <br />Maybe just add to that...to be clear that there's no appearance of <br />impropriety...right...maybe something like that. Mr. Yoshimoto? <br />Is that...are we all in agreement with that...you understand how to <br />translate that into our order? <br />Mr. Yoshimoto: I appreciate as much guidance as the Board can give me so <br />whatever the Board wants me to put in the opinion I will. Nan? <br />Ms. Sumner Mack: Just one more thing we did discuss that...the exception...No. 16 <br />cited in the contract...may not apply to this contract...well should <br />not have been cited as justification for this. <br />Mr. Yoshimoto: So the Board questions the application... <br />Ms. Sumner -Mack: The application of the exception...exemption 16. <br />Mr. Goodenow: Right but maybe we could add...but in and of itself is not evidence <br />of a violation of the Code of Ethics or something like that.
