I. Call To Order
The meeting was called to order by Chair Art Taniguchi at 10:00 A.M., in the
Meeting Room, Department of Liquor Control, Hilo Lagoon Centre, 101 Aupuni Street,
Unit 230, Hilo, Hawai‘i.
The following were present and constituted a quorum:

Taniguchi: I’d like to call this meeting of the Liquor Commission to order. I’d like to ask
everyone to put their phones on vibrate or silent please. We’ll start off with introductions.

II. Approval of Minutes
Taniguchi: Thank you very much. First order of business, approval of minutes. The
June 7, 2018, minutes were circulated via e-mail on July 3, 2018. Can I have a motion to
accept?

Mr. Greenwell moved to accept the June 7, 2018, Liquor Commission
Minutes as circulated; seconded by Mr. Arakaki.

Chu: Good morning, Chairman Taniguchi, members of the Commission, Mr. Gonzalez,
Ms. Fujimoto and Ms. Lim. I’m Newton Chu on behalf of the applicant. To my left,
Thalia Rodriguez who is on the Management Team with Longs here in Hilo.
Taniguchi: You’ve read the report. Are there any changes to the report?
Chu: No, we have no changes to the investigator’s report.
Taniguchi: Can you briefly describe the business for the record?

Chu: It’s Hawaii’s favorite drug store. I don’t have anything to add other than we’re
really happy to be bringing Longs to Kea‘au. It’s a nice sized store, it’s not one of the
largest, but it’s going to be nice, brand new, located next to Shipman headquarters and
across the street from the current Watumull Shopping Center. Do you have anything to
add to it (to Thalia)?
Rodriguez: We’re just looking forward to opening the doors in that new location. Right
now, we have the existing location open in the Kea‘au Shopping Center where we
service about 20,000-plus customers per month, doing about 3,200 prescriptions per
week. We’re looking forward to a larger space.
Chu: Right now, it’s pretty much a pharmacy. It will be a typical retail pharmacy plus the
other things that Longs brings to the community.
Taniguchi: Mr. Gonzalez, do you have any report of protests?
Gonzalez: Thank you, Mr. Chair. The applicant mailed eight out of eight notices within
100 feet, 33 out of 33 notices within 500 feet. There were 28 properties entitled to
protest, and we received zero protests for this application.
Taniguchi: Is there any public testimony regarding this application?
There was no testimony.
Taniguchi: Commissioners, any questions?
Arakaki: I have a question. When do you expect this to be completed? When do you
expect the grand opening to be?
Rodriguez: Right now, the date set would be October 14, 2018.
Chu: There’s also a website where you can watch the daily construction go on. It’s
under KZ Development (the developer). Every so often I check on it. On a rainy day,
there’s not a lot of activity, but right now all the walls are up, the roof’s on, it’s looking
pretty good.
Taniguchi: Any other questions? Is it on the, it’s behind Shipman, so it’s on the
farmers’ market side of the street?
Chu: Right. It’s exactly where the farmers’ market used to be.
Rodriguez: Right. Yes.

Gonzalez: We have been notified that the applicant is not attending. They are off-island
today. So we can proceed without them.

Gonzalez: If there are questions that the Department can answer on their behalf, we will

Hughes: What are they asking for?
Gonzalez: They’re asking for a temporary increase in the premises. Essentially, if
you’re familiar with the location of Umeke’s at Kuakini Center, off of the street within the
parking lot area, they did a new construction and re-did the parking lot. Between the
parking lot for the Kuakini Center and Umeke’s back door there is a large concrete area
that they want to be able to have picnic tables with shade coverings.
Taniguchi: Should I re-read that? We read it into the record already, but should I re-
read that?
Gonzalez: If you read it earlier I don’t think you have to, Mr. Chair.
Taniguchi: Okay. Any other questions? I have a question. I think we brought it up at
the last public hearing, but I’m kind of familiar with that area. Where the sidewalk is at
the end of the building, you have a walkway that’s open. Are they going to block it?
Gonzalez: Are you talking about the walkway that’s closer to the street?
Taniguchi: (referring to the report) In the second picture on the right.
Gonzalez: You’re referring to page two of the report?
Taniguchi: Yes. Yes. Because from there, you can just walk right in, right?
Gonzalez: If you walk towards the street side, you have to walk around the building to
walk into the premises.
Taniguchi: From the street, if you come in this way, if this whole area is a licensed
premises, do they have to or are they intending to block it off or just leave it open?
Gonzalez: There is a hedge between the street and their premises along the streetside,
and there’s a railing between the driveway and this elevated concrete area.
Taniguchi: Unless they put the hedge in later. We had to park outside once and we just
came right in. That’s the question I had because it looks pretty open.
Gonzalez: Okay.
Taniguchi: Commissioners, any other questions?

notices within 500 feet. There were 23 properties entitled to protest and there were zero
protests received.

Kawakami: My name is Yuka Kawakami. I’m the Secretary and Director of
Maruhiro Enterprise, as well as the Office Manager.
Taniguchi: Okay. Have you read the report?
Kawakami: Yes.
Taniguchi: Any changes?
Kawakami: We just have a little change in the floor plan that we had to take off the
office space at the entrance. That was all for now.
Taniguchi: Did you notify the office of the change?
Kawakami: I have a new floor plan.
Taniguchi: Gail, did you get a copy?
Ms. Kawakami provided a copy of the revised floor plan.

Taniguchi: So, the one we have in file is the old one, right?
Waltjen: Probably.
Taniguchi: So what’s the change? Just where your office is going to be?
Kawakami: Just a little bit at the entrance, there is a square space (referring to the
revised floor plan) here.
Taniguchi: When you come in, on the right side? Or left side?
Kawakami: In front. This is the lanai and this is the parking in back. This space
has to be taken away somehow.
Taniguchi: On the left side when you come in the door? Right now you show
tables there?
Kawakami: Yes. Right now I don’t know if we’re going to have tables there.
Taniguchi: That’s basically it?
Kawakami: Yes.
Taniguchi: Can you briefly describe your business?
Kawakami: Sushi Shiono is a Japanese restaurant. We serve sushi, Japanese
cuisine, bentos, and for the new place, we are going to have ramen noodle. We are
thinking of having ramen noodle on the right side and a sushi place on the left side.
It’s like two separate (parts), but together as Sushi Shiono.
There was discussion between Counsel and Chairman.
Taniguchi: Gail and Mr. Gonzalez? Does the change look okay to you?
Gonzalez: Yes, Mr. Chair, thank you.
Taniguchi: Okay, for the record, the change is okay with the Department. Do we
have any public testimony on this application?
There was no public testimony.

Arakaki: How many other restaurants do you have?
Kawakami: We have three restaurants right now--Kona, Waikoloa and Mauna Lani
Resort. We don’t sell liquor at Waikoloa, only bentos, take out bentos. Sushi Kona
restaurant, we are moving to a new place. Construction hasn’t started yet.

We are hoping to have it ready next year. I don’t know how long the construction
will take or how long the Building Department will take, but the final design will be
ready by this month, maybe next week. We will submit everything next week and
see how long it will take. As soon as we finish construction, we’ll move everything
from the current place to the new place.
Arakaki: Current place meaning…?
Kawakami: The Kona restaurant.
Taniguchi: The Kona one.
Kawakami: Yes.
Gonzalez: Commissioner Arakaki, this is an application for change of location in
anticipation of them moving into a newer and larger facility. Once the construction
for this facility at 74-5599 Pawai Place is completed, they would relocate from their
current existing location.
Arakaki: Got it.
Taniguchi: Mr. Greenwell, you had a question?
Greenwell: No, that was it.
Taniguchi: Any other questions? I have a question. I always go to your restaurant
in Kona. Where is this? In the industrial area?
Kawakami: Yes. It’s by the Kona Brewing Company.
Taniguchi: Oh, okay. So it’s a bigger location?
Kawakami: Yes, a little bit bigger.

Jiminez: Good and how are you?
Taniguchi: Good. Thank you for coming in. Do you have an update on the situation
there?
Jiminez: We are still working on it.
Heid: We brought our plans for just the first phase or our plans for that location in Pahoa
to make it somewhat more permanent.
Gonzalez: Mr. Chair, to set the foundation for the discussion today, the last report to the
Commission was that there were no alcohol sales going on but there were food sales in
the area of the increase. Since that last report, there have been no changes. They are
still providing food but no alcohol sales. They have been in discussion with other
departments. They have been drafting plans which are being circulated now to create a
more permanent structure and building in the area of increase. I think the owners can
provide any further details.
Taniguchi: This is not at the old location?
Jiminez: Yes, it is.
Hughes: Is this the KFC location?
Jiminez: No, the KFC location is still…
Heid: We’re waiting on some construction permits.
Taniguchi: My recollection, correct me if I’m wrong, we approved…didn’t we approve
the parking lot liquor sales by the food truck.
Gonzalez: The previous location had burned down, then they set up the food truck.
Taniguchi: And we approved the small premises for…
Gonzalez: Which was in the area in the vicinity of the parking lot of the previous
location.
Taniguchi: Right, and we wanted an update after so long, right?
Gonzalez: Yes.
Taniguchi: So, is this what this is (referring to the draft plans provided by the licensee)?
Gonzalez: This is that area.

Taniguchi: But they never served liquor? I thought we approved it.
Gonzalez: We approved it, but they needed to get other approvals before they could do
that.
Taniguchi: Oh.
Heid: From Planning and…
Jiminez: Fire and electrical and plumbing, and we never passed that.
Heid: So we never served. We started working towards this plan of meeting more
permanent fixtures to meet everybody’s requirements.
Greenwell: The property that you’re putting this thing on, is it your own property or is it a
leased piece of property?
Jiminez: No, it’s my own property.
Greenwell: It’s your own property?
Jiminez: Yes.
Greenwell: You were leasing a parking lot next door?
Jiminez: No, that’s all mine.
Greenwell: That’s all yours?
Jiminez: Yes.
Greenwell: Okay, okay.
Jiminez: It’s all Luquin’s plus the parking lot is my property.

Greenwell: Brandon, this was in six months that they had to come back to us from the
last time they were here?
Gonzalez: To give a status?
Greenwell: Yes.
Gonzalez: I believe so.
Greenwell: Okay, now they don’t have to come back again until they get this building
complete? Is that correct?
Gonzalez: You can ask for status reports from the Department if you want, about the
progress.
Greenwell: But they won’t have to come back?
Gonzalez: If you want to minimize any inconvenience for them.
Taniguchi: We approved the liquor, but they had to jump through more hoops, I guess,
before they serve liquor. So, that was the reason for coming back, right (in six months)?
Heid: Yes.
Gonzalez: Their liquor license is currently inactive.
Taniguchi: Until?
Gonzalez: They renewed it, but it’s inactive.
Taniguchi: If they get through those approvals…

Heid: The County. Planning doesn’t like the tents, so they’re not really interested in
signing off on that. I’ve spoken with the Department of Health. They don’t mind the port-
a-potty situation so much anymore. I don’t anticipate too many problems from them.
I think we would probably need to invest in one of those portable water scenarios for
hand washing. Inside the trailer is for our employees and we’re all set because they
have access to the water and the soap and the towels, but for customer service…I don’t
anticipate too many problems with the Department of Health, but again, it comes back to
the tents and with no somewhat coverage, it’s not real convenient out there when it’s
raining. Or when it’s really hot. Either way, right? You’ll get very sunburned sitting
there…
Taniguchi: I think the concern, and too bad Commissioner Onizuka’s not here because
he had that big concern at the time. But then, if you’re not serving liquor…it’s hard to do
the unknown, right? Maybe, get a status six months after they start serving liquor?
Could we do that? Then they don’t have to keep coming back if they don’t get approval.
Since it’s inactive anyway? What if they start tomorrow and it goes on for three years
until they build a building?
Heid: Yes. Ultimately, I don’t think we would pass our final inspection to start tomorrow.
Taniguchi: Yes, but what Mr. Greenwell…we don’t want to inconvenience you. If you
were serving liquor already and we got the update, I think that’s what one of our
commissioner’s concern (was) about.
Heid: …that we were moving more towards more of a permanent situation.
Taniguchi: But being that you didn’t, kind of defeats the purpose and you waste your
time to come down. So we don’t want that.
Heid: Yes. Absolutely.
Taniguchi: So I was asking if maybe, could we do that then?
Gonzalez: So if the Commission is requesting that we be given a status report six
months after they…
Taniguchi: …they start serving.
Gonzalez: …begin the serving of alcohol, could the Department do that?
Taniguchi: Could we do that? Do you think that’s reasonable? Instead of just going
blanket, not needing to come back?
Greenwell: There has to be something…

Taniguchi: It was originally six, so…it’s up to you (Commissioners). Can we get a
motion from somebody?
Salāve‘a: Mr. Chair, I have a question. The trigger for the liquor permit would be what?
Is there anything…once they get their permits from Planning, Public Works, DOH and
the building is (inaudible), is that the trigger point for it’s activation?
Gonzalez: There’s going to be a final inspection from the Liquor Department to make
sure that all of the requirements pertaining to the liquor laws are up, the “no drinking,” the
“no underage,” if applicable, the “no human trafficking” posters, that they have a copy of
the rules on premises. There was discussion, too, about the area having proper barriers
to prevent people from taking their alcoholic beverages out of the consumption area. So,
once that is done, then it’s a matter of them activating their license with us, making sure
that all of the fees that are due to the Department of Liquor Control are paid up.
Salāve‘a: And that activation wouldn’t include coming before the Commission?
Gonzalez: No, it would not include coming back to the Commission because you
already gave an approval subject to that.
Salāve‘a: So what is being proposed would be upon that? Completing all of those steps
and then the liquor permit being activated six months after that they come in and give a
status.
Taniguchi: Yes, because the problem was one of our Commissioners brought it up and
it was a good point, and of course there was the fire that destroyed their property, was
because they had a temporary food truck outside, they wanted to serve liquor out there.
The concern was he didn’t want it to be forever, so the six-months was proposed. But
being that they never served liquor and they came back, you feel for them having to
come in. At least it’s something, and everybody, hopefully will be here and they might
have other questions (referring to the Commissioners). But, for now, I think there’s really
nothing to ask.
Greenwell: But, making a motion now shouldn’t we…I don’t know how to do it, but it
would have to be contingent on their building.
Taniguchi: No, it’s temporary. See, we approved the temporary, but they never could
serve because they didn’t get approval from all these other areas.
Greenwell: But, it’s saying that they have to get by Planning because of their tents. So
they need to put up a building to get by Planning.
Taniguchi: Right. Right. And they don’t anticipate approval, but what if they get
approved? That’s my question. In other words, the reason for the six-month report was
after you did this outside exception that we approved to get a status update, it’s basically
closing the loop because whenever you give something that’s indefinite, it could go on
for years before the building comes up and then they’re selling liquor outside and there’s
no status report. That was a concern.

Masuda: And what would happened, Mr. Greenwell, if I may, is if they do get the
building and then they have everything approved, they can just go in immediately and
not have to wait for the Commission’s action.
Greenwell: But Brandon said they have to do an inspection.
Masuda: Yes, but that’s going to be before the activation; an inspection will happen.
Salāve‘a: But not in front of the Commission.
Masuda: But not in front of the Commission. So they will do whatever they have to do
within the County. If they can get Planning to change their mind, fine. As long as they
satisfy Liquor Department as far as upon the final inspection they have everything
covered, Liquor Department will then issue them their activation. Six months from the
activation, they’ll come before the board and tell us how it’s going. If it’s a full-on service
building, then I’m sure the Department will give us the status of that and tell them, okay,
it’s like a regular building, it’s no longer some kind of temporary or in between kind of a
situation.
Taniguchi: They already have the license.
Greenwell: I understand that.
Taniguchi: So this is for that outside thing. That’s why we voted for that—the request
for a status update in six months.
Greenwell: My next question is I don’t know how to word a motion to bring them back.
Masuda: If I may, Mr. Chairman, an appropriate motion could just say, “Upon activation
of their license, the Department will have a status report prepared for the Commission,
and the applicants brought back in six-months.” Upon the activation, so they have to be
functioning as a liquor licensee distributor.
Taniguchi: Because actually, if they go into the building already, then it’s moot. Right?
Gonzalez: Yes. This is a good discussion because what we’re trying to game plan is for
things really out of our control. Because one way this can go is they are held to build a
more permanent structure with four solid walls and a solid roof. The footprint of that
building could be bigger or smaller than what we approved. We would need updated
drawings from them when we go for our liquor inspection to say this is the area for liquor
consumption. It could get smaller or it could get bigger. The other departments that
have control over approving what they operate out of might say they can put up some
kind of temporary structure that has fire retardant canvas or roofing.
So, if the question is whether or not the Commission wants to go and take another stab
at its approval of the liquor sales because there’s no clear picture of what they’re going
to sell out of, then that is a valid question. But, if you look at it from this perspective:

the property is owned by the licensee, we have a general idea of the area that was
allowed to have liquor sales where the building once stood. We increased that to include
the parking lot area where their food truck is operating out of, and we focus on that, and
there’s no liquor sales occurring now. The Commission already gave approval for that
increased area for liquor sales given the circumstances. And all we would like is an
update on their progress or how the liquor sales are going with the increased area once
it starts, given the concerns that were raised during the approval. I had it simply as “a
status report within blank months after the licensee begins their alcohol sales.” That
way, if there’s any other concerns, it’s generic enough where the issues that were initially
raised can be addressed.
Taniguchi: So, it’s simple. Is that okay (to the Commissioners)? Make the motion,
David? You want to parrot that?
Gonzalez: The way he worded it was fine.
Taniguchi: But it was kind of lengthy.
Masuda: Want me to repeat it? Here’s a proposed motion. If you like it, you can just
say, “So approved.” What the motion would be is upon activation of the liquor license
and upon sale (which is the same thing, initial sale), that six months after that activation,
you (Mr. Greenwell) would like a status update for the Commission.

improvement to the building for addition of a urinal and addition of a hand sink and
also a three-compartment sink, even though that’s not required by the Department
of Health, for our bar area. Once we get our permits for that, we already have
everybody lined up to do the work which should take minimal time per week. Then,
we will be ready to call for our final inspection and get flying with that one.
Gonzalez: That’s for the location near the…

Taniguchi: The newer side, right?
Heid: Yes, the newer side of Pāhoa.
Gonzalez: Closer to the highway.
Heid: Other than that, yes, we are ready to open and could possibly in the next few
weeks open just for our food. We have all of our food permits. Depending on what
happens in the coming days with everything, it’s so transitional right now. But we’re
looking at possibly doing that and having that work done simultaneously, and
incorporating the liquor after that. That’s the status on that place.

Greenwell: I know I’ve asked this question before and I got some explanations, but if
we start getting involved in ratification for modification of the building, it’s out of our
scope.
Gonzalez: The short answer is our rules require them to apply for an alteration permit
when they change their building and the footprint of the building. It’s a holdover and
carry over of the checks overlapping of governmental agencies approvals. Because
some of the changes may not relate to alcohol sales or storage or our alcohol laws in
particular, it is a safeguard to notify other departments that might need to know about
changes to structures or alterations to structures, like the Building Department. So, it’s
a carryover of that as well.
In this case, they were just erring on the side of caution because they’re not creating
much storage space. Who knows? In the future they might come in for an increase to
store liquor there.
Taniguchi: They might want to store liquor in there.
Gonzalez: So, it’s good for us to know, too. When our investigators go to a premises
and they notice there’s walls removed or there’s walls put up, that kind of change in
space from the floor plans we have on file, it throws them for a loop sometimes. So
this is also good because it keeps our floor plans as up to date as possible.
Masuda: It allows the investigators to know where to look. Right now they’re not
planning for liquor storage. But who knows, right?

alcohol and where they are moored, they are given on land a place for storage. That’s
what this is. It’s a locked, secured warehouse box.
Greenwell: You’ve looked at it? You’ve seen it?
Gonzalez: The inspectors went to take a look to make sure that it is locked and
secured. That was part of the final inspection.
Greenwell: So, that storage will only store liquor for the boat?
Gonzalez: The storage has been approved for storage of liquor. If they want to store
other items in there as well, that’s up to them.
Greenwell: But the liquor from that storage locker can only go to the boat. Is that
correct?
Gonzalez: Correct. That’s where we expect them to store any liquor that cannot be
stored on the boat or served on the vessel.
