Ofice of the Prosecuting Attorney - September 14, 2018 - Amendment Proposal <br />1. Please provide a brief description of: The Proposed Charter amendment, the purpose of the proposed <br />Charter amendment, the issue or problem to be addressed by the proposal, and how the proposal would <br />address the issue or problem. <br />2. If applicable, list the Charter provision(s) affected by the proposal: <br />The purpose of this proposed Charter Amendment is to allow Hawai'i Police Department Chief of Police <br />(HPD) and the Office of the Prosecuting Attorney elected Prosecutor (OPA) to operate, coordinate and <br />oversee the operations of their respective, Management Information Systems (MIS) sections. <br />Due to security requirements mandated by FBI/CJIS that both departments must follow, HPD and OPA <br />need to be able to implement policies, procedures, rules and regulations as well as be able to freely <br />procure any equipment needed to meet the Powers, Duties and Functions of each department. <br />As HPD and OPA are both law enforcement agencies, they share confidential and restricted information <br />vital to successful arrest and prosecution of law breakers. <br />Due to these requirements, not all technological resources can be freely shared or managed by County <br />DIT, HPD and OPA. Every effort will be made to pool resources amongst departments to achieve <br />economy of scale when purchasing bulk items. <br />Under the current charter, responsibility falls upon the County Director of Information Technology. <br />Since the DIT Director falls under the Mayor, their priorities may not align with the Prosecutor or Chief <br />of Police. Also, HPD and OPA receive Federal and State grants that can only be spent on Law <br />Enforcement and must be accepted by either the Chief of Police or Prosecuting Attorney. <br />By having the HPD and OPA MIS/IT overseen by their respective department heads, law enforcement <br />focused technology can be implemented as needed or deemed essential. This also alleviates the <br />responsibility of overseeing OPA and HPD MIS/IT sections by the County Director of IT. Ultimately the <br />Chief of Police and the Prosecuting Attorney will be responsible for the security, planning, maintenance, <br />implementation of their own MIS/IT systems. <br />Chapters affected: <br />Section 6-4.4.
