Civil Service Director and Deputy [Personnel] Civil Service Director <br />shall serve as ex -officio members of the commission in an advisory <br />capacity. <br />(c) The commission shall establish its rules of procedure and <br />adopt rules and regulations having the force and [a]effect of law. <br />(d) The commission shall review and compensate councilmen and <br />council chairman at an appropriate step within a salary range on <br />the same basis as employees of bargaining units to assure a <br />sensible relationship to an adequate scheme of compensation for <br />the work they do. <br />(As amended by Ordinance No. 56, effective November 26, 1974). <br />Section 3.[5].6. Vacancy in Office. When any vacancy occurs in the <br />county council, the remaining members of the council shall appoint <br />as a successor a person of the same political party as the <br />person he succeeds with the requisite qualifications to fill the <br />vacancy. Within thirty days after the occurrence of any vacancy <br />the council chairman shall notify all remaining members of the <br />council .by. registered mail that on a specified regular meeting <br />date formal action shall be taken to fill the vacancy. Should <br />the council fail to fill any vacancy within sixty days after. <br />its occurrence, the chairman of the council shall appoint a <br />successor to fill the vacancy for the unexpired term. The person <br />appointed shall serve until a successor is duly elected at the <br />next State or State and County election and seated. The election <br />shall be held in accordance with the election laws of the State <br />insofar as applicable. <br />The person elected as the successor shall serve out the <br />unexpired term of the person he succeeds commencing at 12 o'clock <br />meridian on the first Monday of December following his election <br />Section 3-[6]7. Removal of Councilmen. Any councilman may be <br />removed by impeachment or .recall proceedings ...as provided by [flaw] <br />this charter. <br />Section 3-[7]8. Organization of the Council; Officers; Employees. <br />(a) The council shall elect from among .its members a chairman . <br />and a vice chairman, each of whom shall serve at its pleasure. <br />Until such time as the chairman and presiding officer shall be <br />elected, the mayor shall preside at such meeting, provided that <br />the mayor shall not have a vote. The chairman, shall preside at <br />council meetings. If at any meeting the chairman is not present <br />or unable to act, the vice chairman shall then preside. In the <br />absence of the chairman and vice chairman, the council shall <br />elect from among its members a temporary presiding officer. <br />(b) The council shall appoint the county clerk which position <br />shall be exempt from civil service laws and classifications. The <br />county clerk shall: <br />(1) Be the clerk of the council. <br />(2) Be custodian of the county seal. <br />(3) Conduct all elections held within the county. <br />(4) Appoint the deputy county clerk and the legislative <br />auditor, with the approval of the council, and such <br />positions shall be exempt from civil service laws <br />and classifications. <br />(5) Perform such other functions as the council may prescribe. <br />(6) Appoint necessary staff for which appropriations have <br />been made by the council, subject to civil service laws <br />and classifications, and exercise the same power with <br />respect to the personnel of his office as the depart- <br />ment heads in the executive branch. <br />(c) The council may hire necessary staff to provide legal and <br />research assistance to the council on all matters related to its <br />
