CHAPTER 3 <br />DEPARTMENT OF LIQUOR CONTROL <br />Section 7-3.1. Organization. There shall be a department of <br />liquor control consisting of a liquor commission, a liquor <br />control adjudicationboard, a director of the department and <br />the necessary staff. <br />Section 7-3.2. Liquor Commission. There shall be a liquor <br />commission consisting of seven members who shall be appointed <br />by the mayor [with the approval of) and confirmed by the council <br />in the manner prescribed in Section 1[3]2.4. Commission membership <br />shall be representative of the community and of the county geo- <br />graphical areas of Puna, Ka'u, Kona, Kohala, Hamakua, and Hilo. <br />The liquor commission shall: <br />(a) Adopt rules and regulations having the force and effect <br />of law for the administration of liquor control in the county <br />and to carry out provisions of the liquor control laws of the <br />State. <br />(b) Grant, renew or refuse applications for licenses for the <br />manufacture, importation and sale of liquor in the county under <br />applicable laws and regulations. <br />(c) Have such other powers and duties as. may be provided by <br />law, not in conflict with the provisions of this section. <br />Section 7-3.3. Liquor Control Adjudication Board. There shall <br />be a liquor control adjudication board consisting of five members <br />who shall be appointed by the mayor [with the approval of] and <br />confirmed by the council in the manner prescribed in Section <br />1[3]2-4. <br />The liquor control adjudication board shall hear and determine <br />all complaints regarding violations of the liquor control laws <br />of the State, or complaints regarding violations of rules and <br />regulations established by the liquor commission and impose such <br />fines or punishment as may be provided by law upon the conviction <br />thereof. <br />Section 7-3.4. Director of the Department of Liquor. Control.. <br />The director of the department of liquor control shall be <br />appointed by the liquor commission and may be removed by the <br />liquor commission. The director of the department of liquor <br />control shall: <br />(a) Be the administrative head of the department. <br />(b) Provide clerical and administrative services for the <br />liquor commission and the liquor control adjudication board, <br />including the submission of budget for the operation of the <br />department. <br />(c) Investigate complaints regarding violations of the liquor <br />control laws of the State or complaints regarding violations of <br />rules and regulations established by the liquor commission and <br />report such violations to the prosecuting officer of the county. <br />Section 7-3.5. Administrative Supervision. The department of <br />liquor control shall come under the general supervision and <br />control of the mayor. <br />a7 <br />
