This bill also would not apply to dwellings where no more than five bedrooms are rented for a <br />period of 180 consecutive days or less, when the owner or operator resides on the building site. <br />These are considered hosted short-term rentals and can include a bed and breakfast establishment <br />or renting rooms of a dwelling on a short-term basis to not more than five unrelated people, <br />which is defined as a "family" in the Zoning Code. A bed and breakfast establishment allows up <br />to ten guests within the five bedrooms and the service of continental breakfast meals. <br />The bill also does not cover dwellings rented on a long-term basis which is typically six months <br />or longer. So, does the Commission have any questions on what a short-term vacation is as <br />defined in this bill? No? Okay. <br />CLARKSON: Iexcuse me. <br />JACKSON: Yes, Joe. <br />CLARKSON: Why is the—why is the word "vacation" in the bill? I mean, I'm just, if <br />somebody is coming and renting a room but they are there on business, does that not make it a <br />vacation rental? I mean, why isn't it just short-term rental for any purpose? <br />JACKSON: Because that's how the bill was drafted. <br />CLARKSON: Okay. <br />JACKSON: And, I'm assuming the intent of the bill was to capture situations, was to mainly <br />capture situations where an entire dwelling is rented out to one group at a time, and there's not <br />some type of operator or host on-site. <br />CLARKSON: Okay, thank you. <br />JACKSON: So, I'm again assuming that situations like travelling nurses and business guests <br />would typically be staying in a hosted rental where somebody lives on the property and just one <br />room is rented out for them to use. <br />So, where are short-term vacation rentals permitted? The bill identifies the following zoning <br />districts and areas where existing and new short-term vacation rentals can operate as a permitted <br />use. This is the Resort -Hotel zoning district; General Commercial zoning district; Downtown <br />Hilo Commercial District; and Village Commercial zoning districts with a Use Permit; and all <br />zoning districts within areas designated by the County General Plan as Resort or Resort Node, <br />except that a Use Permit is required in the Single -Family Residential zoning district within those <br />Resort or Resort Node areas. <br />So, outside of those five areas, new short-term vacation rentals are not permitted but existing <br />short-term vacation rentals may continue to operate if the Planning Director issues a <br />nonconforming use certificate.
