REPLOGLE: Okay. <br />JACKSON: Okay, so moving on to the registration process. That process includes submitting a <br />form and a $250 filing fee to the Planning Department. Along with that application form, the <br />submittal needs to include a site plan showing the location of the rooms for rent and the required <br />parking. The Zoning Code currently requires one parking space for each rented bedroom in <br />addition to one space for the dwelling unit if rooms are rented individually, so if you have a <br />dwelling with three rooms rented, you would need to have four parking spaces if the rooms are <br />rented individually. Or two parking spaces if the dwelling unit is rented as a whole. <br />With the application, verification that State of Hawaii general excise tax and transient <br />accommodation tax licenses are in effect would also need to be submitted along with verification <br />that a letter has been sent to all surrounding owners and lessees within 300 feet of the property. <br />The letter needs to notify them of the details of the operation of the vacation rental such as the <br />number of units being rented, the maximum number of guests permitted, the number and location <br />of parking spaces, and instructions on how to submit complaints to the Planning Department <br />about the operation. <br />RAFFIPIY: Question. <br />JACKSON: Yes? <br />RAFFIPIY: So, the letter, the verification letter is only to notify the neighbors, not to ask them <br />for any permission at all, right? <br />JACKSON: No. <br />RAFFIPIY: Just to notify them that they do have an operation within the neighborhood. <br />JACKSON: Yes. <br />RAFFIPIY: Thank you. <br />JACKSON: Just to notify them that they are registering for this use with the Planning <br />Department. <br />The bill requires that owners of short-term vacation rentals notify the Planning Director of <br />ownership changes or when the establishment ceases to operate for any reason. <br />Let's see, and the slide says, but these provisions are under the registration section, so it's not <br />clear if they apply to all short-term vacation rentals, but again, Council clarified that the intent <br />was to have applied to all short-term vacation rentals so we can make that correction in the bill. <br />Any short-term vacation rental that is not registered within the required deadlines is considered <br />unpermitted and subject to penalties until the short-term vacation rental becomes properly <br />registered and compliant with the requirements of the bill. <br />EXHIBIT C <br />5 <br />
