JACKSON: Okay. <br />CLARKSON: I have never used a short-term vacation rental. I've heard the words Airbnb, but <br />I've never even looked at their site. IsI don't know how it works. Does the advertising direct <br />the potential user to contact the owner directly and pay them directly? Or is contact and payment <br />made through the platform agency like Airbnb? In other words, if the staff of the Planning <br />Department were looking at all the short-term vacation rental advertisers, how would they know <br />who was being advertised? <br />JACKSON: So, I believe that anyone could go on Airbnb and search for a unit and then <br />everything is done electronically like through email. They, there's usually a calendar that you <br />can ask to reserve a certain period of time and then somehow an email must be generated to the <br />owner and let them know that someone wants to rent their unit for this period of time. And, then <br />the payment arrangement is made through the website. <br />But, as far as like how do you know what unit or where the unit is located, these sites usually <br />have really general information. They don't always list like the address of the property, so that <br />would from an enforcement perspective be really difficult to match a property with an address <br />unless it's listed on the hosting platform website. <br />CLARKSON: So, does the State get that information when the hosting platform sends the TAT <br />that they collect to the State? <br />JACKSON: I don't know that answer. <br />CLARKSON: Or, do they even do that? Is this all being done outside normal tax collection <br />law? Well, that, I'm just asking. <br />JACKSON: I don't know that answer. <br />CLARKSON: Okay. <br />JACKSON: Okay, so the bill also proposes to establish a short-term vacation rental enforcement <br />account which would be administered by the Planning Director for the purpose of enforcing this <br />vacation rental law. The account will be funded by fees collected for registration, fees collected <br />for renewal of nonconforming use certificates, and fines collected from enforcement action. <br />So <br />CLARKSON: —Can I just ask another question of Department staff? So, if you were asked to <br />develop a list of all the short-term vacation rentals on the Big Island, could it be done? They're <br />in operation right now. Is there any way for the Department to actually know what's going on? <br />REPLOGLE: No. <br />YEE: They're not registered with us now, so we would have to compile a list. <br />EXHIBIT C <br />9 <br />
