Hawai`i County Charter Commission -4 October 12, 2018 <br />question, is there in addition to the educational requirements that it indicates, are <br />there any legal requirements as a result? Liability that being a PE and a director <br />necessitates, does that come together or is it just simply a signifier of the ability to <br />accomplish the job? <br />MR. SIMEON: I believe having a background with a PE and a background in <br />engineering is important. The administrative requirements, being able to manage <br />the people is important. But yeah, for now. Thank you. <br />CHR. ADAMS: Thank you so much, Director. Appreciate that. This will come <br />as no surprise to the members of the Commission and the staff, but I screwed up, <br />and I skipped our Deputy Director of Planning. And I'm going to do it again. I <br />apologize. I understand that our Mayor would like to make a couple of <br />comments, and if you're okay with that Director Arai, I'm going to allow the <br />Mayor to do that. Mr. Mayor. <br />(Note: At this time, Mayor Harry Kim carne forward to address the <br />members of the Commission.) <br />MAYOR KIM: Thank you for this second opportunity. The reason for that is, <br />sitting back there and listening to some of the comments, prior to speaking to you <br />the first time, I decided not to say certain things, then sitting back there, I thought <br />I should. Because I didn't want to make it like flaunting, or you and me, or those <br />things. First of all on the continent of the Corp. Counsel. That has been a <br />discussion issue for a long time: should the Corporation Counsel be in regards to <br />a separate person hired by the County Council, not a Corporation Counsel, but an <br />attorney to represent the County Council. I can say openly, and this is why I'm <br />saying it here, I've been your Mayor for almost 10 years now. I ask you to find <br />one single attorney that worked with me for 10 years that was ordered to carry a <br />certain position or represent only that position. All attorneys in the Corporation <br />Counsel are advised, "You are here to advise me. You are here to advise the <br />Council. You are not my attorney, you're the people's attorney." Ask any one of <br />them, and I guarantee that's what they were instructed to do. <br />Whether they have a private counsel or not is not totally of that, but don't judge it <br />because of a statement made that they do what the Mayor orders them to do. That <br />has never happened in regards to the past 10 years, my eight years prior and <br />nearly two years now. I don't want to make that sound strong, but I think it is <br />important because our mission here is very important like during lava flow or <br />anything else that the public you represent and I represent trusts us. And if you <br />will see the recommendations we are making, I truly believe it is what we as a <br />body perceive as what is best for this County government that is best for the <br />people. Nothing else is presented to them, and 1 ask to you call any department in <br />private and ask them if that is contrary to the instructions they received. <br />Page 19 <br />
