Hawai` i County Charter Commission -4 October 12, 2018 <br />us need to do a suggestion form for our Charter Commission or would perhaps <br />some of these less substantive things be just taken into sort of a housekeeping <br />measure that we were talking about last time? I mean it is sort of a grey area there <br />you know. <br />CHR. ADAMS: I am going to let Mr. Henricks talk here in a second. I would if <br />it's me, I will default to considering them substantive and then come up with a <br />proposal. But there are those that, but it is going to be the Commission's <br />decision, right, I mean we are all going to take a look at these proposals and we <br />are going to vote them aye or naye right?, and so, the idea though that we are also <br />developing this housekeeping... <br />MS. GALIMBA: List. <br />CHR. ADAMS: List or you know, I'll turn that over to our analyst. <br />MR. HENRICKS: Thank you. I guess the first thing would be, I wouldn't say <br />there is really an in between. Either it matters or it doesn't and I think that you <br />had said that well. And I know that you had started. You have a proposal on <br />today's agenda that uses the word "rephrases" and I think that when you use that <br />word, the pure intent is not to change any meaning whatsoever but to clarify <br />wording so that it reads better and also perhaps there's no legal arguments as to <br />what it means. And those things that would fall into that category could be <br />included into the proposal by way of an amendment or they could be handled <br />separately. <br />It would be best probably if we have something that we are going to call a <br />"housekeeping amendment" that is all in one proposal because again, it wouldn't <br />make sense to have several proposals that—their intent is to rephrase, clarify, but <br />not change the meaning at all. I think the example you gave of taking out ex - <br />officio members is meaningful right?, so, and I know that we have staff that's <br />working with the Chair to try to find areas of the Charter that would meet that <br />criteria of being purely to clarify but not change meaning whatsoever, so and I <br />agree that it will be up to you folks to discuss that and then get guidance as to — <br />from legal counsel as well, whether or not that to be the case. <br />MS. GALIMBA: Okay. <br />MR. HENRICKS: But again, it would be best to have one proposal if we want to <br />call it a "housekeeping" proposal, but when you are thinking about that, again, not <br />changing meaning and not changing how things work or how they are constituted, <br />membership or anything of that nature. Even some of the suggestions from the <br />Planning Commission to take out transitional provisions, you consider that <br />housekeeping because there are historical, but I wouldn't. I think that goes <br />beyond what we would call a housekeeping amendment. <br />Page 30 <br />
