CaII To Order The meeting was called to order by Vice Chair Art Taniguchi at 10:00 A.M., in the Meeting Room, Department of Liquor Control, West Hawaii Civic Center, 74-5044 Ane Keohokalole Highway, Building B, 2nd Floor, Kailua-Kona, Hawaii. Pursuant to Section 92-7, Hawaii Revised Statutes, as amended, Item 1, No. 16, is the proposed amendment to the agenda and has been determined not to be of reasonably major significance nor does it affect a significant number of persons, and is proposed for placement on the agenda by two-thirds vote of the Commission. 1. Under New Business, add Item No. 16, new paragraph to read: 16. We are moving to a new location at the Brewery Block and doing sushi and ramen (noodle). Taniguchi: Director, any record of protest? Napoleon: I'm a lounge/restaurant open seven days per week now, serving appetizers and open til 2:00 A.M. Taniguchi: Any report of protests? Takase: Mr. Chairman, the applicant mailed 11 out of 12 notices within 100 feet, and 85 out of 90 notices within 500 feet. There were 82 properties entitled to protest. We received no protests to this application. Taniguchi: Is there any public testimony on this application? There was no public testimony. Taniguchi: Since none, Commissioners, any questions? Director? Takase: Gary, we've been receiving reports about litter out there. I know it's not you, but it's only your patrons down there at night, so I'm asking you to try and help police up the area. Napoleon: We are. We're working on it. I actually contacted the County, but the response I got from them at the time of contact was there are more important things like the volcano and we will worry about that later. That was during the time of the volcano, so now that it's done, they've been cooperating with me a lot. We actually got them to order the cigarette stand. We'll get that in about another two weeks. Takase: Okay. Taniguchi: What kind of litter? Napoleon: Cigarettes. Takase: Well, some bottles. I don't know if the cigarettes had come from your place. That's been a problem with nightclubs. Patrons go outside during a break or they drink in their cars and come back inside. I don't know if you're charging a cover or not. Taniguchi: Commissioners, any other questions? Taniguchi: Since none, Commissioners, any questions? Nahale-a: I have a question. I remember last time we were questioning something about this applicant. I think it was in regards to the restroom? How far from the restaurant it was going to be? I was wondering if that's been followed up on or rectified. Is it even in our purview? Takase: 1 am not sure actually, what the Department of Health is doing; if they're looking at it at all. But, Mr. Kim indicated that the restrooms that they created behind are compliant. Kim: Yes, facing Kuakini Highway. The County approved the location, considering the ADA code. From our business space to access the restroom, I didn't think we had any issues with that, but I'm sure the health department or County inspectors will let us know once we get the final say on it. Cook: That is correct. In speaking with my client, there's really only two main clients that he has, Kahua Ranch and one of the ships. Garcia: Ocean Sports Boats. Cook: His specialty is barbeque. Garcia: We do a barbeque dinner at Kahua Ranch once a week, and then we do the catering for Ocean Sports Boats, which we drop off and pick up. For the ranch, it's the only place that I would serve any beer and wine, and I would pull a monthly catering permit from the department. When I submit that, I submit a site plan, a plot plan and a letter from the owner stating that they will comply with the Liquor Commission rules and regulations.
