Mink <br />Councilmember, 9th District <br />City and County of Honolulu <br />Honolulu Hale <br />Honolulu, Hawaii 96813 <br />Dear Councilmember Mink: <br />Re: Section 7, Article 11, Hawaii State <br />Constitution, *Resignation from Public Office' <br />This is in reply to your letter dated May 16, 1986, in <br />which you requested an opinion as to whether section 7, article <br />1I of the State Constitution requires you to resign to run for <br />another office, the term of which begins on the first Monday of <br />December 1986. Your present city council term expires on <br />January 2, 1987. <br />We are of the opinion that section 7, article I1 was never <br />intended to apply to officeholders whose successors would be <br />elected at the same election in which they are candidates for <br />another office. Accordingly, we do not believe you are <br />required to resign under the circumstances described in your <br />letter. <br />Section 7 provides as follows: <br />Any elected public officer shall resign from that <br />office before being eligible as a candidate for another <br />public office, if the term of the office sought begins <br />before the end of the term of the office held. [Emphasis <br />added.) <br />The Hawaii Supreme Court has stated over and over again <br />that the fundamental principle in construing a constitutional <br />provision is to give effect to the inrenrion of the framers and <br />AG Op.
