UNGER: Okay, assuming a 20-year extension is required. <br /> <br />KAY: Assuming a 20 – well, ultimately, they are required to comply with conditions of <br />approval through the end of development. And so, really they are still, they are not getting out of <br />anything, should the Council decide to not require a 20-year time extension; they still have to <br />comply with all the conditions of approval until the development is complete. <br /> <br />UNGER: No question. But now we are adding and changing those conditions. <br /> <br />KAY: Yeah, to the extent that generally we normally do that for these older Changes of Zone; <br />we update language to standard condition language. So there is nothing here that’s really jumps <br />out of the ordinary that we are making a substantive change. <br /> <br />UNGER: Okay, and certainly the applicants can add to that as well. <br /> <br />KAY: Certainly, yeah. <br /> <br />YATES: I have a question regarding public access. <br /> <br />KAY: Yes. <br /> <br />YATES: Is there any? <br /> <br />KAY: So I will have the applicants address this a little bit more, but my understanding is public <br />access has been made available. There is the interpretive center as well. The interpretive center <br />and then opening up the cultural reserve area is kind of on hold right now pending State Historic <br />Preservation Division approval of a preservation plan. And the applicants can address kind of <br />where that’s at in the process. <br /> <br />YATES: Okay, I’ll hold my question for them. <br /> <br />KAY: Okay, thank you. <br /> <br />UNGER: Commissioner Carr Smith. <br /> <br />CARR SMITH: I was saying an opportunity for the Planning Department to create a policy or <br />procedure to deal with a situation like this so that we don’t have to appear like we have no <br />history or don’t know what to do with this. <br /> <br />KAY: I would, that is an opportunity. This is such a rare occasion, or rare situation. Like I say, <br />it’s very strange that we didn’t provide an opportunity for an administrative time extension. It’s <br />very strange that we required a 20-year overall status report. That’s not something that is usual <br />or normal in what we do.
