We come up with an informal advisory <br />opinion...it doesn't mean anything right? You gotta go to the <br />contested hearing to really find someone if they don't accept it <br />right? So you look at those two approaches I just think the Maui <br />approach is what a board of our...in the way we are in charter <br />that's very appropriate. The board does everything as a whole. <br />There's no special investigation type...now but that's <br />philosophically. I think if we look back at like the last kind of <br />thing we had. There was a complaint right and so what if in that <br />scenario we said it's confidential cause it deals possibly with <br />personnel matters so we will do this all behind...in closed session. <br />And then we appoint one person maybe Mr. Yoshimoto <br />our...probably not though cause he's a county employee...it would <br />probably be one of us maybe. And that person can go and do all <br />these things now you can't force an outside person to swear under <br />oath but what are the departments going to do when you walk in <br />there and what's corp. counsel going to say...oh you gotta say <br />under oath you know ask these questions...answer these questions. <br />Maybe you want that but I just think...you know it could be <br />abused as well...I don't wanna change my name to Ken Star <br />Goodenow. Sorry the joke didn't come across good cause I had it <br />my notes how to present this. But this is the key philosophical <br />question that we're looking at I think when we start this discussion. <br />Personally if it were me...I like Maui's rules...I would change <br />three things...I made a list of them and we can talk about them <br />later. But the way it reads is it's really we are in the role of a <br />judge...we do not help the plaintiff prove anything. It's <br />where...I'm sorry the petitioner...the petitioner would come and <br />make their case. And again when we do the informal part we can <br />learn stuff but that doesn't mean anything cause when we're sitting <br />in a formal hearing...it's all new...it's only the evidence and we <br />just hear it as it comes and we make our ruling. That I think is an <br />appropriate role for us and I think we should take the Hawaii <br />County rules...the portion that deals with investigation and their <br />whole procedure and put in the Maui language with a few <br />alterations that I can talk about. Let's go back to the lady <br />that we had that came in and filed the petition...against the county <br />for hiring this person yeah I forget which name that was but you <br />remember the one that yeah and then we found out that there's 14 <br />special contracts that the Mayor has and you know all of this but I <br />really felt for her in her presentation because she was <br />4 <br />
