Masuda: Mr. Mukai, can you be fair and impartial in sitting and hearing this? <br />Mukai: Definitely. <br />Masuda: Thank you. <br />Giffin: Mr. Chairman, my husband and I have resided in Kamuela for over forty years now <br />and during that time, we've known the Wakayama family including Alvin during that time. <br />We've known them well. However, I can honestly say that I can sit here and make a very <br />prudent decision on this case. <br />Masuda: Can you be fair and impartial? <br />Giffin: Yes. <br />Fuke: Thank you. <br />Masuda: That's the standard. <br />Fuke: As Chair, I have the same situation as Board Member Giffin. The conclusion would <br />be the same, Counsel? <br />Masuda: Yes. <br />Fuke: Can I ask Assistant Corporation Counsel to read the Complaint and Accusation and <br />Answer to the Complaint? <br />Schoen: Thank you, Mr. Chair. The Complaint states that on or about the 5th day of <br />June 2018, in the County and State of Hawaii, the Licensee, Wakayama Family Store, <br />Inc., dba Kamuela Liquor Store, did fail to have a person duly approved by the Department <br />of Liquor Control as a person in active charge of the premises at all times while the <br />premises was open for business to provide proper supervision in the exercise of the liquor <br />license in accordance with the liquor laws, in violation of Rule 5-2 of the Rules and <br />Regulations of the Liquor Commission of the Department of Liquor Control of the County <br />of Hawaii, State of Hawaii. <br />Fuke: Thank you very much.
