As the Licensee stated, there was a previous violation on <br /> August 22, 2014, related to violation of Rule 3-8-B, patrons remaining on the premises <br /> after 2:00 A.M. He does claim that he has been in good standing for the past 12 years. <br /> Actually, there was a violation in 2006, for possession of consumption of liquor within <br /> the premises after business established by the Commission. There was also a violation <br /> of Rule 3-6-C, failure to pay timely payment of percentage fees and also another <br /> violation in 2005, for failure to file report of Initial Report of Gross Liquor Sales. The <br /> Department is recommending a fine be imposed for each Count of$1,000. The fines for <br /> Count I, II, IV, V, VII and VIII, be suspended. And fines for Counts III, VI, and IX, be <br /> imposed for a total of$3,000. We are asking that the suspension of the fines be on the <br /> condition that no further violations occur within 12 months of receiving the Decision and <br /> Order and payment of the $3,000 that is being imposed, immediately, be paid within 30 <br /> days of receipt of Decision and Order. The license in this case was issued temporarily <br /> on November 12, 2003. <br /> Lindsey: Is there any discussion on the penalty? <br /> Fuke: I just had one clarification. Renee, the suspension and the reduction would be <br /> predicated upon no similar violation of any other infraction of the rules? <br /> Schoen: Yes, no further violation within 12 months and payment of$3,000. <br /> Fuke: So that's any violation? <br /> Schoen: Any violation. <br /> R. Looking at the Investigator's Report, there were <br /> problems that occurred on December 8th and problems that occurred on December 10th <br /> Are those two different violations? If you're found guilty first, is the second one found <br /> on the 10th a subsequent violation that would maybe have a higher penalty? <br /> Schoen: No. <br /> R.
