But, you're saying with $900 suspended? <br /> Mr. Smith moved that the non-Licensee in Case No. 2017-001, be <br /> assessed a penalty in the amount of$1,000.00 with $900.00 to be <br /> suspended for twelve (12) months from the date of service of the <br /> Decision and Order, on the condition that there are no similar <br /> violations (HRS 281-3) within that period; and that $100.00 is to be <br /> paid within thirty(30) days upon receipt of the written Decision and <br /> Order; seconded by Mr. Fuke. <br /> Schoen: Yes. <br /> R. Smith: And again, just to clarify, if there is a further violation in the next 12 months, <br /> the $900 is due? <br /> Schoen: No similar violation. So, in other words, selling without a license. <br /> Lindsey: Motion has been made to suspend $900 of$1,000. Chair asks all those in <br /> favor say "Aye." <br /> The Board members voted "Aye." <br /> Lindsey: All those opposed say "Nay." <br /> There was no opposition by the Board members. <br /> Lindsey: Chair votes "Aye." Motion carried. <br /> The motion was carried unanimously. <br /> Schoen: Mr. Chair, the Decision and Order will be prepared and served upon the <br /> non-Licensee.
