Fuke: Correct me if I'm wrong. There was a situation at the Sheraton Keauhou where <br /> there was a family who came in for dinner and the guy was playing music beyond ten <br /> o'clock. The neighbors across the bay made a complaint then the music stopped. <br /> Didn't we suspend a portion of the fine? <br /> Takase: Yeah. <br /> Fuke: Or I think this situation is a little different because the police had to come and the <br /> guy was playing music up until midnight, two hours after close time; whereas the <br /> Sheraton restaurant musician was only about 15 minutes over. <br /> Takase: I think this last Sheraton one was actually a $1,000 fine. Previously, we had a <br /> $1,000 fine and suspended $500. In this case, there are two reasons. One, yes he was <br /> playing longer. Two, the managers on duty knew nothing about any conditions on their <br /> license. <br /> Fuke: Thank you. <br /> Lindsey: I'd like to call for a motion on the penalty. <br /> Fuke: I move that we accept Counsel's recommendation. <br /> R. Smith: Second. <br /> Mr. Fuke moved that the Licensee in Case No. 2017-002, be assessed <br /> a penalty in the amount of$1,000.00 and that$1,000.00 is to be paid <br /> within thirty (30) days of receipt of the written Decision and Order. <br /> Failure to pay within thirty (30) days shall subject the Licensee to <br /> additional separate penalties including an Order to Show Cause to <br /> prove fitness to hold a liquor license; seconded by Mr. Smith. <br /> Lindsey: It has been moved and seconded. Is there any discussion? <br /> There was no discussion from the Board members. <br /> Lindsey: Hearing none. All those in favor say "Aye." <br /> The Board members voted "Aye." <br /> Lindsey: Those opposed say "Nay." <br /> There was no opposition by the Board members. <br /> Lindsey: Chair votes "Aye."
