Schoen: Thank you Mr. Chair. The Complaint states that on or about the 1st day of June, 2017, in the County and State of Hawaii, Kmart Corporation, dba Big Kmart #7683, a corporate Licensee, did elect Robert Riecker, as Vice President, Controller and Chief Acting Officer, received on May 17, 2017, effective June 1, 2015, and failed to notify the Liquor Commission of the Department of Liquor Control in writing of the election within 60 days from the date of election, a violation on Rule 4-6(B) of the Rules and Regulations of the Liquor Commission of the Department of Liquor Control of the County of Hawaii, State of Hawai'i. The Licensee has selected Alternative IV, admitting the allegation and stipulates that disciplinary action may be taken without their presence. They have waived their right to a hearing and elected to pay a fine pursuant to Rule 1.12. Lindsey: Thank you Counsel. The Chair would like to entertain a motion to find the Licensee in violation of the charge. Smith: So moved. Fuke: Second. Mr. Smith moved that the Licensee in Case No. 2017-010, be found in violation of Rule 4-6(B) of the Rules and Regulations of the Liquor Commission of the Department of Liquor Control of the County of Hawaii, State of Hawaii; seconded by Mr. Fuke.
