Fuke: Can I ask Counsel to please read the history and recommended penalty? Schoen: Yes, Mr. Chair, the Department is recommending a $1,500 fine with $1 9000 suspended for one year from the date of the service of the Decision and order on the condition that there be no similar violations and that is Rule 3(A), and that $500 is to be paid within 30 days upon receipt of the Decision and Order for the violation made payable to the Department of Liquor Control. This recommendation is based on the fact that the Licensee has taken responsibility and there have been no violations of this rule within the last five years. For those reasons, we recommend the particular fine which is also consistent with the Kea`au case that we were speaking about earlier. Fuke: Is there any discussion on the recommended penalty?
