Hawai`i County Charter Commission -8 February 8, 2019 <br />a fund to be called the PONC Maintenance Fund." I guess that must be from CA - <br />7, that is not as helpful either. I want to make sure that we are actually talking <br />about the right thing. Unfinished Business. Alrighty, here we are. <br />Alright, so if we go to Old Business, when you go to CA -7, Draft 2, under Section <br />10-15. <br />MS. RICE: What page please. <br />CHR. ADAMS: Page one on the Charter Amendment in Old Business. Charter <br />Amendment No. CA -7, Draft 2. I apologize for the minute taking and for the <br />public. 10-15 (a) currently says "In adopting each fiscal year's budget and capital <br />program, the council shall appropriate a minimum of one percent of certified real <br />property tax revenues, 0.75% of which shall be deposited in a fund known as the <br />public access, open space, and natural resources preservation fund and the <br />remaining 0.25% of which shall be deposited into a fund to be called the public <br />access, open space, and natural resources maintenance fund. <br />The council may by a two-thirds vote suspend this appropriation requirement <br />when the director of finance determines in writing that the suspension of this <br />appropriation is necessary to prevent a reduction in the level of public services." <br />That is what is in 10-15 (a) in CA -7, Draft 2. <br />Commissioner Todd's amendment took away the second paragraph there, so the <br />paragraph that says "The council may by a two-thirds vote suspend..." that whole <br />paragraph, those lines disappear. And then in (a), in the paragraph above, the way <br />it is phrased now it says "in adopting each fiscal year's"... the way it is phrased in <br />the amendment... "In adopting each fiscal year's budget and capital program, the <br />council shall appropriate a minimum of two percent of certified real property tax <br />revenues, which shall be deposited in a fund known as the public access, open <br />space, and natural resources preservation fund and an additional 0.25% shall be <br />deposited into a fund to be called the PONC maintenance fund." That is the <br />amendment. That's the amendment that we are voting on. Is there any discussion <br />on that amendment? Commissioner... <br />MR. ROEHRIG: I am lost. The amendment is doing what with the percentage? <br />Point seven five... <br />CHR. ADAMS: So one moment. Right, so the .75 percent that is listed in <br />Charter Amendment No. 7, Draft 2, disappears, that whole thing goes away. <br />MR. ROEHRIG: So that takes us to the two percent. <br />CHR. ADAMS: That's correct and also the .25 percent for the maintenance fund. <br />MR. ROEHRIG: Okay. Thank you. <br />Page 30 <br />
