AN ORDINANCE AMENDING CHAPTER 21,ARTICLES 1 AND 4, OF THE HAWAI'I
COUNTY CODE 1983 (2016 EDITION,AS AMENDED),RELATING TO SEWER
SERVICE CHARGES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I:
SECTION 1. Purpose. The purpose of this ordinance is to increase wastewater service
charge rates and introduce a new service class for hotels. The introduction of the new class and
the increases to existing classes will increase the ability of the Department of Environmental
Management, Wastewater Division;to be self-sustaining regarding operations and maintenance
and less reliant on the County's General Fund. These increases will secure the resources needed
to sustain and upgrade sewer infrastructure.
SECTION 2. Chapter 21, article 1, section 21-2, of the Hawai`i County Code 1983
(2016 edition, as amended) is amended by adding a definition to read as follows:
'Hotel"means the same as defined in the Hawai`i Revised Statutes, section 486K-1."
SECTION 3. Chapter 21, article 4, section 21-36.1, of the Hawai`i County Code 1983
(2016 edition, as amended) is amended to`read as follows: .

SECTION 4. Material to be repealed is bracketed and stricken.New material is
underscored. In printing this ordinance,the brackets,bracketed and stricken material, and
underscoring need not be included.
SECTION 5. Severability.If any provision of this ordinance, or the application
thereof to any person or circumstances is held invalid, such invalidity shall not affect •
other provisions or applications of the ordinance`which can be given effect without the
invalid provision or application, and to this end,the provisions of this ordinance are
declared to be severable.

SECTION 6. This ordinance shall take effect on January 1,2027.
