Dear Sir: Thank you for your letter of July 20th advising that you have no recordof our letter to the Mayor and County Council dated April 21, 1970, requesting formal abandonment of a portion of the Old Kailua-Keauhou Middle Roadacross the land of Puapuaa, North Kona. We enclose herewith a photocopy of that letter together with attachedcopies of the Surveyor' s description andmap and. certificate of title. Presumably, copies thereof are in the hands of the State Department of Land. & Natural Resources and. County Department of Public Works as indicated. McCarthy and L . M. Prince , Jr. , general partners of Puapuaa-Kona Land Co. , we respectfully request that the County of Hawaii formally abandon and vacate a portion of the old Kailua-Keahou middle road across their land of Puapuaa in North Kona and offer the same to them as abutting owners in accordance with § 264-3, Hawaii Revised Statutes . That road parcel containing 86 ,264 sq . ft. is described in the attached survey description and shown outlined in red on the attached map , both prepared by Charles L. Murray , registered surveyor, and is also designated generally as a portion of Tax Map Key 7-5-17-25 . It is our understanding that this segment of the old Kailua-Keahou middle road is not accessible from the Kuakini Highway at its point of contiguity in Puapua- anui and thus has long since ceased to serve any public purpose. Further, as stated in the attached certificate of title , there appears to have been no formal dedication . of this road by either conveyance or surrender. These factors should affect not only the availability for aban- donment but the reasonable price required of the statutory offering. McCarthy and Prince are the owners of all the land of Puapuaanui and Puapuaaiki abutting both sides of this road parcel . Its abandonment and disposal to them is requested to confirm and perfect their title under deed dated November 20 , 1968 , recorded in the Hawaii Bureau of Conveyances in Boolc. 6328 , page 164, enabling them to plan the integral development of the entire area.
