SUBJECT: C-970 and 970. 1 - Old Kailua-Keauhou Middle Road
Pursuant to the Committee's referral of the subject roadway, our
department made a further study and considered the possibility of
exchanging the roadway for a piece mauka on the new alignment of
Kuakini Highway. The realignment of Kuakini Highway is a State Highway
project and the exchange of land should be referred to the State Highway
to be negotiated between the State Department of Land and Natural Resources
and the abutting land owner upon the County abandoning and quit claiming
the roadway. Chapter 171, Public Land (Hawaii Revised Statutes), covers
the disposition of government land by the Board of Land and Natural
Resources and public land exchange with private properties.
Attached is a quitclaim deed for a portion of the subject roadway which
was reviewed and approved by the Corporation Counsel's office and is
submitted for your consideration and adoption. The quitclaim deed requires
the Mayor's signature.

This is in further reference to your September 19, 1969
request for a quitclaim of the State of Hawaii ' s interest in
a portion of the old Kailua-Keauhou Middle Road at Puapuaaki
1st, and Puapuaanui 1st, North Kona, Hawaii, Tax Map Key
7-5-17 (Hawaii) recently abandoned by Council of the County
of Hawaii Resolution No. 282 of January 13, 1971.
The State Department of Transportation is studying a
proposed Kuakini Highway realignment which will apparently
pass through your lands and has requested that we withhold
sale of the subject remnant until the right-of-way requirements
for the proposed Kuakini Highway realignment are finalized.
