Date' JUL 2 0 2020 RE: Support of Health and Safety Protective Resolution 678-20 Aloha Honorable Hawaii County Council Members: On behalf of KeepYourPower.org, a coalition of Hawaii residents concerned about the proliferation of harmful wireless technology and advocating for safe technology, we are writing to support Resolution 678- 20. We support you in following the Precautionary Principle when it comes to this untested technology in order to protect our health and wellbeing. We respectfully request that this Resolution be passed. Almost 20 municipalities in the US have passed legislation to ban, pause or restrict the deployment of 5G infrastructure. Four states have passed laws concerning the 5G rollout, particularly regarding health effects, and legislation has been proposed in seven states, including Hawaii. Despite what the wireless communications industry lobbyists might want you to believe, the Resolution does not conflict with Federal law. In fact, quite the opposite. The power and authority to regulate cell towers and antennas in Hawaii County lies with Hawaii County. When the Telecommunications Act of 1996 was being crafted, telecoms lobbied hard to restrict local authority, however, congress did not abide. They did the opposite. Section 47 USC 332 C 7a clearly states that local governments have the power to regulate the placement of wireless facilities. Here is the exact wording of 47 USC 332 C 7a: (7) Preservation of local zoning authority (A) General authority "Except as provided in this paragraph, nothing in this chapter shall limit or affect the authority of a State or local government or instrumentality thereof over decisions regarding the placement, construction, and modification of personal wireless service facilities. " It is of utmost importance that you do please exercise your power and responsibility to regulate 50 infrastructure because, although the FCC sets the exposure limits, the FCC does nothing to actually apply or enforce those limits.
