RESOLUTION NO. 724 20
RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER
INTO AN AGREEMENT WITH THE UNIVERSITY OF HAWAII'S HAWAII
NATURAL ENERGY INSTITUTE FOR THE ACCEPTANCE OF A
DONATION OF A HYDROGEN BUS
WHEREAS, the University of Hawaii's Hawaii Natural Energy Institute is
donating a 2014 Eldorado Aero Elite 29-passenger bus (hydrogen bus) to the County of
Hawaii's Mass Transit Agency; and
WHEREAS, the bus will be used as part of the Mass Transit Agency's
transportation fleet; and
WHEREAS, the County of Hawaii will not be obligated to pay a service and
handling fee, but will be required to pay for the cost of shipping from Oahu; and
WHEREAS, pursuant to Hawaii Revised Statutes, Section 46-7, this Council's
consent is required to enter into this agreement; and
WHEREAS, Article XIII, Section 13-12, of the Hawaii County Charter provides
that the Council, on behalf of the County, may accept gifts of donations of money,
securities or other personal property or of real estate or any interest in real estate, and
Chapter 2, Article 30, Section 2-162 (a) of the Hawaii County Code states that any gifts
or donations of money, securities, or personal property which fall within the
capitalization procedures of the Department of Finance, may be accepted by resolution
approved by the Council; and
WHEREAS, the County of Hawaii's Mass Transit Agency recommends the
acceptance of this donation; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in
accordance with Article XIII, Section 13-12, of the Hawaii County Charter, and Chapter 2,
Article 30, Section 2-162(a) of the Hawaii County Code, the Council of the County of Hawaii
accepts this donation.
BE IT FURTHER RESOLVED that in accordance with section 46-7, Hawaii Revised
Statutes, that the Mayor of the County of Hawaii is authorized to execute, on behalf of the
County, the agreement and any related documents with the University of Hawaii's Hawaii
Natural Energy Institute to receive this donation as indicated above.
BE IT FINALLY RESOLVED that a letter of appreciation and a copy of this resolution
be sent to Mitch Ewan, Hydrogen Systems Program Manager, Hawaii Natural Energy
Institute, 1680 East-West Road, POST 109, Honolulu, Hawaii 96822.
