RESOLUTION NO. 728 20
A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR LEASE OF REAL
PROPERTY FOR THE COUNTY OF HAWAII OFFICE OF THE PROSECUTING
ATTORNEY
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other
obligation requiring payment of funds from the appropriations of a later fiscal year or of more than one
fiscal year be approved by resolution; and
WHEREAS, the Office of the Prosecuting Attorney now requires a space more suitable to their
needs and desires to lease approximately 3,328 square feet of a warehouse situated in Keaau, County
and State of Hawai`i, from Milo Storage LLC ("Landlord"); and
WHEREAS, Office of the Prosecuting Attorney desires to enter into a multi-year lease
agreement is anticipated to commence on October 1, 2020, for a five-year term, with the option to
extend the lease for two (2) additional five (5)year terms with Landlord; and
WHEREAS, Office of the Prosecuting Attorney is requesting authorization for the Mayor to
enter into a multi-year lease agreement with Landlord for warehouse space; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
Honorable Harry Kim, Mayor of the County of Hawaii, is hereby authorized to enter into a multi-year
lease with Milo Storage LLC, for a five-year term with options as indicated above.
BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years to
cover the anticipated obligations of the County under the terms of the Lease.
BE IT FINALLY RESOLVED that County Clerk shall transmit a copy of this resolution to:
(1) Mayor Harry Kim; (2) Department of Finance; (3) Office of the Prosecuting Attorney; (4) Craig T.
Masuda, Deputy Corporation Counsel, Section Chief; and (5) Milo Storage LLC, 16-665 Milo Street,
Kea'au, Hawai`i 96749.
