MR. FUKE: Good morning, Madam Chair, members of the Council. My name is Sidney Fuke. I'm a planning consultant for the applicant. This was discussed in Committee. And I believe like after considerable discussion as far as location, what the intended project was, and the reason for the delay, the amount of effort that the applicant prepared from the initial approval till now I think was indicative of the applicant's sincerity to complete the project. He's asking for an additional five years to do that. And if he can't do that, then unfortunately, he's going to have to come back before this body to plead his case again. My name is Miles Chong. I'm the captain of the Ka`u Patrol Division. This was a grant applied for through the State Attorney General's office to prepare, respond, and prevent COVID-19 (Coronavirus Disease 2019). And the purpose of this grant was for equipment purchases intended to create additional workspaces in the main district stations as well as any substations. And the additional workstations were intended to enhance social distancing requirements to a greater extent than is already occurring and to provide equipment to the substations to provide an alternate worksite in the event of a work-related outbreak. Page 5 Hawaii County Council-49 August 19,2020 Res. 692-20: ADOPTS AND SUPPORTS THE `AINA ALOHA ECONOMIC FUTURES INITIATIVE FOR THE COUNTY OF HAWAII Seeks to adopt this initiative as a guiding principle, and encourages widespread use of the four-step process by individuals, businesses, and organizations throughout the State. Reference: Comm. 1011 Intr. by: Ms. Kierkiewicz and Ms. Lee Loy Approve: GREDC-6 (Note: Comm. 1011.2, from Council Member Susan L. K. Based on our robust conversation during Committee, Council Member Lee Loy and I wanted to elevate a couple of amendments to strengthen this resolution and to provide clarity around the intended recipients of the document. So, that's contained in a communication that's in your pinkie folder. Motion to Amend: Ms. Kierkiewicz moved to amend Res. 692-20 with the contents of Comm. 1011.2. Seconded by Ms. Lee Loy. ACTING CHR. EOFF: Okay. Just let me check if everyone has a copy. Does everyone have that? Okay, go ahead. MS. KIERKIEWICZ: Thank you, Chair. So,just a couple of amendments to the resolution. We are asking that department heads, agency heads, review the AAEF (`Rina Aloha Economic Futures) framework and identify ways in which we can infuse this into the work of the departments and the decision-making process. And we just wanted to be clear on who the intended recipients were: all department heads, our Governor, and so forth. And we look forward to working with the future Administration to see how we can further integrate what we really believe are some transformative change in systems into the way County government operates. So,just asking everyone for their support. ACTING CHR. EOFF: Any comments? Page 6 Hawaii County Council-49 August 19,2020 MS. LEE LOY: Yeah, Chair, please. ACTING CHR. EOFF: Ms. Lee Loy. MS. LEE LOY: Thank you, Chair. Yes. And thank you, Ms. Kierkiewicz, for helping me to put this together. As she had mentioned, this is kind of elevated out of the conversation. I also did walk these back to Noe Noe Wong-Wilson and Mahina Paishon because they were the ones kind of offering these suggestive edits. And they both have given their blessing to adding this strengthening language to a resolution that they can use to further their conversations across the State as it relates to `aina aloha economic. Chair, I yield. ACTING CHR. EOFF: Any other comments? MR. RICHARDS: Chair? ACTING CHR. EOFF: Mr. Richards. MR. RICHARDS: Yeah, thank you, Chair. I just wanted to weigh in on this a little bit. I wasn't here for the conversation, but I was on a, I don't know what it was, Zoom or Webex oranyway, a virtual conversation. That was quite a robust conversation. Kimo Lee was on it. And Kimo said something that really rang home with me. He said, the importance of the `aina aloha is that it's looking forward. It's not going to look backwards. It's going to look forward and plan for the success of the future. And that's what really kind of embraced me. I really was taken by looking to the future and really want to make things better. And so, the verbiage in this—and Noe Noe was on that conversation as well. I think going forward with this is this is a great way to—we're at a point now where we're trying to redefine who we are and how we're going to go forward with our government and with our economy right now. I think this just folds in very nicely. So, with that, I'm wholeheartedly going to be supporting this. Chair, I yield. ACTING CHR. EOFF: Okay, and we're still discussing the amendment. So, is there are any other comments on the amendment? MS. KIERKIEWICZ: Not on this side, Chair. ACTING CHR. EOFF: Ms. Villegas. MS. VILLEGAS: Yeah. I guess just a quick question for clarification. I love the idea of the Administration, it being a requirement for the different departments to Page 7 Hawaii County Council-49 August 19,2020 really make sure that there's some accountability for reading the `aina aloha initiative. I guess I'm wondering at the process of—and perhaps, Ashley, you could help me understand a little better what the process then would be if they are creating a report on how it's going to be implemented and which issues they see it most directly affecting and affecting planning. Who does that report then go to? Or how does that get communicated? MS. KIERKIEWICZ: Sure. That's a great question; if I may answer, Chair. ACTING CHR. EOFF: Go ahead, Ms. Kierkiewicz. MS. VILLEGAS: Thank you, Ashley. MS. KIERKIEWICZ: Thank you, Chair. Rebecca, great question. I think resolutions are as good and as strong as the Council Members that are willing to put in the work to carry it forward because these don't have the teeth of law. So, Council Member Lee Loy and I will be working directly with the department and agency heads to ensure that they submit a report or to encourage them to do so. And in compiling all that information, we would love to be able to provide a copy of that to the Council. I think there's a lot of mana`o from folks that have been in these positions over the last four years and hopefully that it can be used as a tool, as a springboard for the incoming Administration to just really understand and find ways that if those things work or not. But certainly we want to make sure that as the transition happens, this information is available to the incoming Administration. But we will make sure that any reports that have been submitted are provided to this body for the record. MS. LEE LOY: Chair, if I might follow up with that. ACTING CHR. EOFF: Okay, go ahead, Ms. Lee Loy. MS. LEE LOY: And thank you, Ms. Kierkiewicz and Ms. Villegas. And during our Committee conversation, Mahina really kind of put out a challenge that we would maybe pick or identify a couple of departments that could maybe model this type of framework and start to shift how we demonstrate `aina aloha economics just within small departments. So as Ms. Kierkiewicz mentioned, we're going to be leaning back into the next Administration and encouraging them to help demonstrate some of these models just within the departments themselves. Page 8 Hawaii County Council-49 August 19,2020 I recall Mahina mentioning maybe Parks or Planning Department, but we also have to be patient and see what that next Administration looks like. But I think this is a good call to action to the next Administration that's stepping in. Chair, I yield. ACTING CHR. EOFF: Thank you. Ms. Villegas,you still have the floor. MS. VILLEGAS: Yeah, I think this is great. Thank you so much. It conjures a memory from my career at Kona Brewing Company when we created the brand fillers, essentially. And they created a framework of and a foundation for when we needed to make decisions regarding that brand, that they needed to be aligned with that value system. And I'm really grateful and excited to see this incorporated into how County government operates because I think it holds us accountable in a capacity even just beyond Robert's Rules and the processes that govern how we need to behave here in Chambers and in government. But it creates a value system that is connected, tied to, and fundamentally accountable to the host culture and the wisdom of the people of this land. So, thank you so much for lining this up and creating a process for this transition as we transition administrations in this pivotal time in our County's history. So, thank you. Thank you so much. So, we do continue to look at our partners in the community, that we can't do it all by ourselves. We're going to need help: government, public, private partnership. (Note: At this time, Police Lieutenant Rio Amon-Wilkins came forward to address the members of the Council, via videoconferencing from Hilo.) Page 11 Hawaii County Council-49 August 19,2020 MR. AMON-WILKINS: Good morning. Lieutenant Rio Amon-Wilkins with the Hawaii Police Department, Criminal Investigations Section. This grant is for the National Integrated Ballistic Information Network, also known as NIBIN, through the ATF (Bureau of Alcohol, Tobacco, Firearms and Explosives). It enables investigators to match ballistics evidence with other cases across the nation as well as on the island and the State. This process will help reveal previously hidden connections between violent crimes in different states and jurisdictions. NIBIN technology compares images of submitted ballistic evidence from shooting scenes as well as recovered firearms, and it produces a list of possible similar results. Currently, NIBIN has been used by the ATF and other law enforcement agencies for approximately 23 years. In that time, there's been over 223,000 NIBIN leads and over 126,500 NIBIN hits have been identified. Currently, there's over 4.2 million pieces of ballistic evidence, which has been input into NIBIN, and there are over 45 million images stored in the system. Currently, it has produced over 67,000 investigative leads from the over 220 NIBIN locations in fiscal year 2019. This project, the Police Department would begin going through all the firearms that we currently have in evidence. It's estimated that there are over 3,000. Not all of those firearms will be applicable to this. Only certain firearms fall into the criteria to be test fired and for the evidence to be submitted into NIBIN. So, we really don't have an idea, out of the 3,000-plus firearms in evidence, how many would be applicable. We have to go through all of them one by one. And if there are shell casings which have been recovered, those will be submitted, if applicable, and then we'll have to test fire each applicable firearm twice, recover the shell casings and then submit them to NIBIN. MS. DAVID: Thank you very much, Officer Amon-Wilkins, for that explanation. The reason I asked you to do that is because this matter was asked to be waived from Finance. So, the discussion is happening here in Council. So, thank you very much for taking the time to be here, and I ask for my Council Members' support. Thank you. ACTING CHR. EOFF: Thank you, Ms. David. Lieutenant, thank you for being here. I noticed on the background report it's an option to create an account to appropriate the money for a period of July 2020 to June 30, 2021. What happens after that window is expired? MR. AMON-WILKINS: Our department, or I'm actually working on a policy so future firearms required will be test fired as they're recovered, and the evidence will be submitted into NIBIN so we don't have a problem with the backlog again in the future. MS. LEE LOY: And so at the sunset of this particular account, will you need to establish a second account, or it's based on funding? MR. AMON-WILKINS: I believe that we'll be able to test fire the firearms as part of the investigation when the firearm or evidence is recovered, rather than having a backlog and having to use grant funding to take care of it. I believe it'll just be part of each basic investigation. MS. LEE LOY: And so the sunset of the account would not affect future work as it relates to ballistic testing. MR. CHUNG: I don't know how you guys feel about this but—and first of all, thank you, Maile, for waiving this out of Committee. We're looking at a lot of uncertainty, not as much as the State, I will say, but we do have some uncertainties ahead of us for sure. And as I stated in the resolution, the hiring of individuals in the County is one way that we have direct influence not so much the Council, but the Administration—on the County as a whole. And I just think it would be prudent—at least until a new Administration is able to come in and assess this situation with fresh eyes that we institute a hiring freeze. Now, this is really just an urging of the Administration because we, the County Council, don't have any direct control over this. Of course when the budget comes along, there's certain things that we could do to undo some hirings that we find to be improper—"improper"might not be the best word, but something that wasn't advisable. It's very interesting, though. Yesterday afternoon we got a letter from Mayor Kim regarding this measure (See Comm. 1034.1). It's not against the resolution and seems to sort of say that they're implementing some type of hiring control right now within the Administration. But what concerned me is that there's a second paragraph that says that they're closely monitoring their finances and budget, and"the Expenditure Review Committee continues to meet to review Page 19 Hawaii County Council-49 August 19,2020 all equipment and other purchases" and that"the real property tax collection deadline is later this week. If collections are significantly lower than expected, then more stringent spending and hiring practices will be implemented." But the converse might be true in that if the tax collections are not lower, then it's spending as usual. And that's a dangerous thing because it's not just over the short term that we're fearful of. It's really over the long haul that we have all of these uncertainties. Now, if you juxtapose this with something that we received actually just this morning, coincidentally from another, well, former mayor, but he doesn't address himself as this, but this is from William P. Kenoi (See Comm. 1034.2). And these are all unsolicited, of course. I didn't tell the Mayor to submit anything, and I certainly didn't tell Mayor Kenoi to do the same either. But it's interesting that two mayors would weigh in on this. And former Mayor Kenoi seems to be more in support, in fact very much so in support of the resolution that is being entertained right now. In his second paragraph, it says, "All hiring should come to a screeching halt except for Police, Fire, and Civil Defense"—and that pretty much mirrors what we had put in our resolution—"and essential hires that are justified and approved by the Hawaii County Council. This should include positions that are in every phase of the hiring process . . . ." This is something interesting because he has more insight into this whole recruitment than we do here on the County Council. And it says, including posting, recruitment, interviews, and selection. So, even something that's in the process, it should come to a halt according to him. "The County should not be investing in long-term budgetary commitments in the next three months when there is so much uncertainty and unpredictability about our financial situation in the upcoming fiscal year." Not saying I'm going to side with former Mayor Kenoi only because he's siding with our resolution, but I will point out that this is an individual who navigated the County through probably the worst, except for now, but up until that time, the worst economic situation that we had seen. That was through the great recession. And he skillfully did that. And he actually negotiated something that the present administrations, whether it's at the County level or the State level, was able to do, and that was to negotiate a furlough arrangement with the public employee unions. So, he really put his neck on the line in trying to address a really tough situation. And so, I wanted to point out that he had submitted testimony as well. But that's all I had to say. And hopefully—again, this is a nonbinding resolution. We can't really control what the Administration does. But perhaps in our own way, it could be viewed as a policy statement, not a policy directive but just a statement on the part of the Council as to what we believe should be done just over the short term. And as you quite well articulated, it's not about the short game. It's the long game. And I think we need to be fiscally very cautious going into this. I am hoping we are going to be okay. But a lot of these projections we had back in May was predicated on the reopening of our tourism in July then August then September. So, Chair, I fully support this. And I agree, this is a statement of our direction, not a directive. So, I support the intent. Chair, I yield. ACTING CHR. EOFF: Thank you, Mr. Richards. Anyone from Hilo? MS. KIERKIEWICZ: Chair? In reviewing the letters that came from Mayor Kim and Mayor Kenoi, what concerns me about Mayor Kim's letter was it stops short of saying that they would implement a hiring freeze. And that really concerns me because our families, and we know folks, our constituents, are being forced to make do with less. We at the County have to exercise that discipline as well. And so, we're going to do our best as the Council to keep a watchful eye on this situation. But going forward, it's going to be a world of hurt. And so, I'm really hoping that the present Administration really takes this resolution to heart and makes decisions that are good for our future because we're going to be on the Council for the next couple of years, and we are going to be strapped to make these very difficult decisions. But I would think that if it's grant funded—Federal grants; it's not money coming out of the County coffers that should be okay as long as it's with the understanding that these positions will not—there's no guarantee that those positions will be funded after the grant funding is exhausted." Some of you guys weren't, well, maybe you were only in diapers at the time, but I recall in the West Hawaii Today, there was a picture of people lining, I think it was Queen K(Queen Ka`ahumanu) with signs asking or demanding for the Lako Street extension connector to Alii Drive. Now of course, I know there are some issues relating to the residents, of course, along that place. But for the greater good of Kona, they were asking for that Lako Street extension. This was during Lorraine Inouye's mayorship. Okay. This was back in, like, I think either 1990 or 1989 or somewhere around there. I still vividly recall that picture.
