PWMTC-25 August 18,2020 Res. 701-20: ACCEPTS THE DEDICATION OF ROADWAY LOTS A-1, A-2, AND A-3, IDENTIFIED AS TAX MAP KEYS: 4-5-011:042, 4-5-011:043, AND 4-5-011:044, SITUATED AT NAMOKU, DISTRICT OF HAMAKUA, ISLAND AND COUNTY OF HAWAII, STATE OF HAWAII, FROM WOO FAMILY LIMITED PARTNERSHIP, A HAWAII LIMITED PARTNERSHIP The landholder seeks to dedicate the roadways and all improvements for public roadway purposes. Reference: Comm. 1022 Intr. by: Ms. Lee Loy (B/R) Motion to Approve: Mr. Richards moved to recommend adoption of Res. 701-20. Seconded by Ms. Kierkiewicz. CHR. LEE LOY: I believe this is in Ms. Poindexter's district, but she's not here. But I'll open the floor to any comments, questions. Alright, seeing none, we have a motion to approve Resolution 701-20 with a favorable recommendation to the Council. I just want to draw the rest of Council Members to the background report. The dedication is acceptable by Corporation Counsel, Planning, Department of Environmental Management, Water, and DPW (Department of Public Works). Alright, all those in favor, signify by saying "aye." Vote on Res. 701-20: The motion to recommend adoption of Res. 702-20 (Approved) was carried by the following voice vote: Ayes: Committee Members Chung, David, Eoff, Kaneali`i-Kleinfelder, Kierkiewicz, Richards, Villegas, and Chair Lee Loy —8. Page 2 PWMTC-25 August 18,2020 Res. 702-20: ACCEPTS THE DEDICATION OF ROADWAY LOTS A, B AND C FOR KONA VISTA SUBDIVISION, UNIT 4, BEING COLLECTIVELY TAX MAP KEY: 7-6-027:105, SITUATED AT HOLUALOA 1 AND 2, DISTRICT OF NORTH KONA, ISLAND AND COUNTY OF HAWAII, STATE OF HAWAII FROM KV3, LLC, A HAWAII LIMITED LIABILITY COMPANY The landholder seeks to dedicate the roadways and all improvements for public roadway purposes. Reference: Comm. 1023 Intr. by: Ms. Lee Loy (B/R) Motion to Approve: Mr. Richards moved to recommend adoption of Res. 702-20. Seconded by Ms. Kierkiewicz. CHR. LEE LOY: I believe this is in Kona. Any discussion? MS. VILLEGAS: Yes,please. Do we have anybody here? The Administration, would be Mr. Yamamoto. CHR. LEE LOY: No, we don't. We can get him here. MS. VILLEGAS: Okay. This goes back to 2016. Is the property owner or representative of the development here? CHR. LEE LOY: No, Ms. Villegas. Did you want to ask a question? MS. VILLEGAS: This is Rebecca. CHR. LEE LOY: Yes, did you want to ask a question? MS. VILLEGAS: Yeah, I just wanted to get, you know, confirmation as this goes back a number of years on this project. And just last year, there were a lot of concerns about future projects in this area. So I just wanted get confirmation that this is in fact just completion of a prior agreement and dedication of these roads to the County and just have a better understanding, because this goes back to predates my term here on the County Council. It looks like these agreements go back to February of 2016, and I just would like to know why it took so long and why they're doing it now. CHR. LEE LOY: Well, based on the background letters from Corporation Counsel, let's see, DPW (Department of Public Works), also Planning, Water, and Environmental Management, this is a dedication deed of the roadways A, B, and C, so I'm just trying to probe who you want to ask so we can have that respective department kind of address your questions. Page 3 PWMTC-25 August 18,2020 MS. VILLEGAS: And I'm trying to get an understanding from this map. It looks like these roadways A, B, and C, are predominant. Well, C and B, are cul- de-sacs, and A is—would be great is the developer was here to answer some questions as they're giving this to the County. Of if DPW could come and provide some guidance. Is it DPW then, for these roadways that would be ? CHR. LEE LOY: Yes, that's correct. So DPW would accept the road dedication. But normally these are done as satisfaction of conditions for a zone change, and that's why I'm trying to probe who, of what department, you want to query as far as the satisfaction of this dedication. And what conditions it is meeting, whether it's the road condition with DPW, and if that's been met satisfactorily; or if it's with Planning, and that developer is satisfying a condition of approval. MS. VILLEGAS: Thanks, that's great clarification. I think it would probably be Planning then, because it seems that this actual structure of the roadways probably meets the requirement. It appears that meets the requirement; however, I guess, you know, I would like to more from Planning about what this relates to as we're heading into the potential of this being connected to other permits. CHR. LEE LOY: Sure. If you want to give us a few minutes, I can have staff have Planning Department come and answer your questions. MS. VILLEGAS: That would be wonderful. Thank you so much. CHR. LEE LOY: Sure. If you take a look at Planning Director's memo, this project site; it's in full compliance with the provisions of Chapter 23, the Subdivision Code (see Comm. 1022). But if you give me a few minutes, I'll have my staff get Planning Department. Mr. Clerk, with that, I'll put the meeting in recess. MR. BROWN: Thank you. VILLEGAS: I just wanted to say I was able to get the answers that I was looking for; so in an effort to keep the meeting flowing and to avoid Planning having to come down, I can follow up before first reading with any other questions that I have.
