Your Committee on Finance, to which was referred Bill No. 196, reports as follows:
Bill No. 196, transmitted by Council Member Susan L. K. Lee Loy, via Communication No. 1059
dated August 27, 2020, amends Chapter 2, Article 4, of the Hawai`i County Code 1983 (2016 Edition,
as amended), by adding a new section relating to Fiscal Impact Statements.
This bill allows for the Finance Director to initiate, or any Council Member to request from the
Finance Director, a Fiscal Impact Statement for any Bill for an Ordinance, except for Bills that
initiate an amendment to the Hawai`i County Charter or that establish the upcoming fiscal year
operating budget or capital budget.
A motion to move Bill No. 196 to Council with a positive recommendation was made by Council
Member Susan Lee L. K. Loy, and seconded by Council Member Herbert M. "Tim" Richards, III.
Discussion on Fiscal Impact Statements had, and although not mandatory, would be a great tool for
Council Members to better understand how a particular legislation would financially impact the County,
allowing them to make better decisions for our island County, especially going forward from COVID-19
when budget analysis is critical. Additionally, the value of not passing a particular legislation may end up
the result, as well; and the idea of valuing environmental degradation and loss of cultural resources could
be considered. Consensus of Council was in support of said bill as it was a good tool to have, however
noting some small clarifications necessary to tighten it up.
Your Committee on Finance is in accord with the purpose and intent of Bill No. 196, and recommends
its passage on first reading.
