'♦YY . <br /> COUNTY OF HAWAII -fA * STATE OF HAWAII <br /> BILL NO. 196 <br /> ORDINANCE NO. <br /> 20 79 (DRAFT 2) <br /> AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 4, OF THE HAWAII COUNTY <br /> CODE 1983 (2016 EDITION, AS AMENDED), BY ADDING A NEW SECTION <br /> RELATING TO FISCAL IMPACT STATEMENTS. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Chapter 2, article 4, of the Hawai`i County Code 1983 (2016 Edition, as <br /> amended), is amended by adding a new section to be appropriately designated and to read as <br /> follows: <br /> "Section 2- . Fiscal impact statements. <br /> (a) "Fiscal impact statement" means a concise assessment of the immediate and <br /> potential future effects a proposed ordinance may have on revenues, expenditures, <br /> taxes, and fiscal liabilities. <br /> (b) A fiscal impact statement for a proposed ordinance that affects the revenues, <br /> expenditures, taxes, and fiscal liabilities of the County may be initiated by the <br /> director of finance at any time, or upon a council member's written request <br /> submitted to the director of finance no later than 4:30 p.m. on the date of the first <br /> required council reading of the proposed ordinance. The director of finance shall <br /> submit the fiscal impact statement to the council no later than noon on the <br /> business day prior to the second required council reading. Nothing in this section <br /> shall be construed to limit the ability of the council to act on a proposed ordinance <br /> in the absence of a requested fiscal impact statement. <br /> (c) This section shall not apply to any proposed ordinance to amend the Hawai`i <br /> County Charter or to establish the operating budget or capital budget for the <br /> following fiscal year." <br /> SECTION 2. New material is underscored. In printing this ordinance, the underscoring <br /> need not be included. <br /> SECTION 3. Severability. If any provision of this ordinance, or the application thereof <br /> to any person or circumstance, is held invalid, the invalidity does not affect other provisions or <br /> applications of the ordinance which can be given effect without the invalid provision or <br /> application, and to this end the provisions of this ordinance are severable. <br />
