Amendment to Chapter 25 (Zoning Code), Article 2, Division 6 of the
Hawaii County Code 1983 (2016 Edition, as amended) Relating to Use
Permits
(Action Timing and Revocation)
The Windward Planning Commission, at its meeting on November 5, 2020, reviewed and
considered the amendment of Chapter 25 (Zoning Code), Article 2, Division 6, of the Hawaii
County Code 1983 (2016 Edition, as amended), to update the time and revocation requirements
for the Windward Planning Commission and Leeward Planning Commission to act on and
revoke a Use Permit to be consistent with the Planning Commission Rules of Practice and
Procedure.
The Commission voted to forward a favorable recommendation to the County Council on the
request.
The draft bill is attached for your favorable consideration. We have also enclosed a copy of the
Planning Director's Background and Recommendation and a draft transcript of the hearing for
your information to be provided under separate cover.

The Leeward Planning Commission, at its duly held public hearing on October 15, 2020, considered the
above -referenced request initiated by the Planning Director for an amendment Chapter 25 (Zoning
Code), Articles 2 and 6 of the Hawaii County Code 1983 (2016 Edition, as amended), relating to Use
Permits. The purpose of these amendments is to update the time and revocation requirements for the
Windward Planning Commission and Leeward Planning Commission to act on and revoke a Use Permit
to be consistent with the Planning Commission Rules of Practice and Procedure.
The Commission voted to forward a favorable recommendation to the County Council on the request
with added language to Section 25-2-64 (c); unless an extension is agreed to by all parties.
The draft bill is attached for your favorable consideration. We have also enclosed a copy of the
Planning Director's Background and Recommendation and a draft transcript of the hearing for your
information to be provided under separate cover.
