I would really like to thank Kawehi Inaba and Laʻiʻōpua 2020. What they have been doing so far during this pandemic in serving and feeding our communities has been outstanding. I am providing additional funds so she can continue her good work with her staff and crew in the Ka‘ū area, very needy rural communities. And I really thank her for all her efforts. VILLEGAS: I also want to express my sincere gratitude to Ms. Inaba, Kawehi, for her work with Laʻiʻōpua. The time and energy that she has taken to identify restaurants in the Ka‘ū area and to utilize local businesses in order to keep these CARES (Coronavirus Aid, Relief, and Economic Security) funds and the contingency funds for feeding our people within a circular economy, essentially, here on island. And supporting our local businesses and really having also a focus on supporting our local farmers so that the food that’s being provided to feed our people is food that’s being grown by our people and prepared by our people. And I think that’s just really an exemplary model for how we’re utilizing both contingency funding and CARES funding. So, I just want to mahalo you again, Kawehi, for all of your work and your diligence, your creativity, your tenacity, and your dedication to feeding the people of our island. Mahalo. ACTING CHR. And after speaking with the local Mainstreet Pāhoa group, they asked me to help them fund some cameras that function via Wi-Fi for their community. So, I think it’s a good way to start developing a way for the community to really push public safety in Downtown Pāhoa where you’re having a lot of issues. So, I ask for everyone’s support. This particular resolution is attached to the CDBG-DR Page 13 Hawai‘i County Council-55 November 6, 2020 (Community Development Block Grant-Disaster Recovery) Action Plan that the housing committee considered yesterday and unanimously voted to defer to the call of the chair. KIERKIEWICZ: I asked Douglas and Finance Director Sako to reach out to HUD (United States Department of Housing and Urban Development) to understand implications for the deferment. (Note: At this time, Disaster Recovery Officer Douglas Le, Planning Department, came forward to address the members of the Council, via videoconferencing from Hilo.) MR. LE: Douglas Nam Le, Disaster Recovery Officer. Thank you, Council Members, Chair, for kind of giving us time to provide an update relative to the conversations at the housing agency yesterday. Based on the housing agency’s decision to postpone the item regarding approval of the Community Development Block Grant for Disaster Recovery Action Plan, we did reach out to HUD on our understanding of kind of where we stand now, given the considerations yesterday. And I think two important facts are what we want to come back to report on. Based on where we are today, in terms of having an approved action plan with HUD and pending a grant agreement with the agency, essentially for any future decisions to amend or change the action plan, that now kind of falls under what I had explained briefly yesterday is a substantial amendment. So, to change the program, to add new programs, etcetera, reallocate funding, essentially, in order to take that step the County has to enter into a grant agreement. When the County enters into a grant agreement is an act that we have some discretion on. But I think it’s just important to know because it came up during the housing agency discussion as to how do things work with our—in terms of our collaboration with HUD moving forward and decisions that, kind of, the housing agency and Administration have regarding this program. I think a related topic that came up is around the timely expenditure funding. This grant must be spent within six years. It can be spent in less than six years. But just for everyone’s awareness, really, that clock of six years begins at the execution of the grant agreement. And so, at that point in time, the Page 14 Hawai‘i County Council-55 November 6, 2020 Administration is able to move forward with the appropriate approvals from the housing agency and Council to execute a grant agreement. That would actually start the six-year timeline to expend the funds. MS. KIERKIEWICZ: So, just to clarify, Douglas—I want to make sure I get this right—if we enter into an agreement today, the clock will start ticking. MR. LE: That is correct. MS. KIERKIEWICZ: Okay. MR. LE: To administer the funds. MS. KIERKIEWICZ: And because we have no action plan that has been approved by the housing agency, my preference is that we defer this particular resolution and the companion measure to our next Council meeting. I’d like a bit more time to discuss with you, Finance Director Sako, and HUD about how we move forward, knowing that we still need to go back to the housing agency and kind of potentially rework that document, also keeping mind that there is a transition in the Administration. And based on yesterday’s discussion, it was very clear that we wanted to make sure that the new mayor and his team also had an opportunity to kind of weigh in on this. And most importantly, that we are getting broader community feedback. I got a lot of messages yesterday from community, just really pleased with the fact that we are hitting the pause button on this one. I think the County Clerk and I actually initiated this on behalf of our Elections Division. We might be able to give some background to this resolution and request. MS. DAVID: Yes, then. Clerk Henricks, could you give us just a brief explanation of this grant? MR. HENRICKS: Yeah. I’ll let Deputy Brown start and then I’ll fill in any blanks or finish it off, as he was taking the lead on this project to help to secure these grant funds for elections. MS. DAVID: Thank you. MR. BROWN: So, this was a grant opportunity that we were made aware of from our friends and partners in the City and County of Honolulu. Their county clerk made us aware of this opportunity. The Center for Tech and Civic Life is a nonprofit organization that got funding from a very generous private donor. I think there were a couple of donors. And their whole mission was to provide counties, small municipalities with resources to help provide a safe, secure election here in 2020. And so, we jumped on the opportunity to try to secure some funds that would help in our transition to our all-mail election, you know, dealing with COVID (coronavirus disease) and making sure that we had as many resources on the ground as possible to help operationalize a safe and secure election here. And I want to give a big shoutout to the elections team, their staff, Pat Nakamoto who did a wonderful job on all the days leading up to the election and especially election day. And so, Jon and I kind of put the grant application together. We put it out as soon as we could. And this very generous nonprofit, based on our application, awarded us with $177,193.75. So, we are looking at using that for multiple things: getting more infrastructure on some of our driver registrations, everything from ballot drop boxes to security measures on making sure that these drop boxes are safer. We’re actually looking into if we can help utilize some of that money toward the ballot sorting machine that we’ve purchased last year. So, we’re very excited and happy that we were able to be awarded these funds from a private nonprofit. And yeah, I think that’s kind of the summary. If anybody has any questions, we’re here. I yield. ACTING CHR. EOFF: Okay, thank you. Ms. Villegas. MS. VILLEGAS: Yes. Thank you for the opportunity to speak on this measure. I received dozens of emails from concerned constituents. And I feel it’s unfortunate that, after our last meeting, there was an article in the newspaper that reflected the potential of something that wasn’t what happened. There was not a closed-door meeting. There was not negotiations in order to concede to developer requests. But I understand the public’s propensity to believe that way because I, myself, growing up serving this community as an activist and tending to be very cautious about any developments and cautious about the intention of developers, as well as cautious of those in government, that it’s very easy to just assume that when a meeting happens, it’s to concede to all of the wishes and desires of a developer. I’m really proud and grateful to state that, that was not what happened in that meeting. And what did happen was the concessions were put—the amendments that had been requested to be removed were put back. And the developer’s been working in very good faith to meet the requirements of the Planning Department. Ideally, this would have happened on the front-end and not happening while we’re here in Council. However, this is a part of the process, and this is a part of serving, I feel, my district and my community. And I would love for this district to remain more rural and be old Kona. But I have to be honest with myself and with our constituents that we have to be aware that, according to the General Plan and the CDP (Community Development Plan), these areas are slated for TOD (transit-oriented development) developments. It’s walkable communities. And as we navigate a path to consciously and, with as much wisdom and experience as possible, work with the landowners and the developers and Planning Department and navigating a path to building the best Kona possible, that’s being built over the people that live here. And not necessarily—I mean, I don’t want to see constant creation of housing developments for people from elsewhere to move here when those that live here need to be able to afford homes. But that is the history of the current landowners. When I look at their history and their commitment to our community, I see a legacy of that kind of commitment and honoring the needs of the places that they participate in as a developer. Page 24 Hawai‘i County Council-55 November 6, 2020 So, with that being said, I do have the intention and am communicating with a number of constituents. And I want them to know—I want them to have the time to look through this communication that outlines the amendments that were made and the concessions that were put back in. And I want them to have the time to review it and to make comment. And we’ll be working on—we’ll be helping to facilitate, ideally, a community meeting, which will allow for ideally Mr. Yee, the Planning Director, and representatives of the Planning Department, as well as representatives of the developer to be available. For them to answer the questions of the constituents. And for this to move forward in a pono capacity. And for there to be a broader understanding and a reminder that this really is just a time extension on zoning. The entitlements that come with it, yes. And there have been deep-dive negotiations into making sure that the entitlements that continue to come with this property for a new property owner are appropriate and conducive to our community and its growth and benefiting all of us. SAKO: Hi. So, the microwave system is actually our communications system island-wide. And so, every few years—I think it’s every ten—we have to replace a certain part of the microwave to get our communications system, which public safety uses, to keep working. So, this is that we need an additional appropriation of 2 million to cover the cost. MS. VILLEGAS: Thank you, Deanna. That is really helpful, and really grateful for these kinds of technologies, which keep us able to connect and communicate with one another. ACTING CHR. EOFF: Any other questions, Council Members, or comments? MR. KANEALIʻI-KLEINFELDER: Deanna, the original appropriation was for 4 million. This is an increase to $6 million? MS. SAKO: Yes. That’s correct. MR. KANEALIʻI-KLEINFELDER: What is the increase due to? MS. SAKO: Part of it is just increased cost. And then, part of it is to expand it with a little bit better system so that the communication will work better. We have several hard-to-reach areas on the island. MR. KANEALIʻI-KLEINFELDER: Is this what was being discussed yesterday with the HELCO (Hawai‘i Electric Light Company, Inc.) transmission lines? MS. SAKO: Sorry, I didn’t get to hear that discussion yesterday. MR. KANEALIʻI-KLEINFELDER: Now, they’re discussing new transmission lines in the Kilauea Volcano area. MS. SAKO: Oh yeah, no, I think this is different. This is just our communications system that has the towers throughout the islands that our radios utilize to work. And then—yeah. So, it’s not related to the HELCO one. MR. KANEALIʻI-KLEINFELDER: And when you say, “increase in cost,” you’re saying increase in equipment cost or just a general increase in—? MS. SAKO: Yes, equipment cost. I mean, equipment cost. And then, I’m sure having to transport it to our island probably by sea. And that additional surcharge didn’t help as well. And so, I’m just wondering if this investment is going to increase the ability for first responders to communicate with each other. MS. SAKO: We are working on multiple projects at the same time. So, this is replacing the microwave system in our current towers. And then, additionally, we have the bigger tower and megahertz change that has the new towers in it. And then, we’re currently working on the FEMA (Federal Emergency Management Agency) project down in Puna to replace the tower that was taken out by the lava. That’s actually HELCO’s tower but we’re working on putting our equipment back on. I believe HELCO has the tower built now, and so, we’re working on getting our equipment back on the tower. And I have no objection to that addition to the Code so long as it is not read as mandatory that every wastewater treatment is required to recycle.
