Appointment of Planning Director
Greetings:
Several have asked my opinion concerning the qualifications for the office
of planning director contained in Section 6-7.2(a) of the county charter. When
the nominee does not have "a [college] degree" in designated fields, the nominee
must have five years of"training and experience in a responsible planning
position," three of which years must be inn "an administrative capacity."
Planning is a multi-disciplinary subject of recent origin, the central focus
of which is on land use regulation. Persons can obtain such "training and
experience" through work with government agencies as regulators or through
work with non-regulators life universities, the military, nonprofits, land
managers, developers and lenders. The charter does not require the nominee's
"training and experience" be in the regulatory sector or in the non-regulatory
sector. Nor does the charter require the nominee to have a particular value
preference, to favor or oppose certain concepts or policies.
The appointing authority is "satisfied" that the nominee is "able" to
perform the duties of the office as provided in Section 1 -3 of the county
charter. The question presented to the county council then is whether the
nominee's "training and experience" are satisfactory to the council. Thank you
