I'm writing to express my vehement opposition to the nomination of Zendo Kern for the
Planning Director position. I'm disappointed in Mayor Mitch Roth for bringing forth the
nomination of this individual who, quite frankly, does not meet the qualifications as
expressed by the Hawaii County Charter. You would think that a mayor with
prosecutorial experience would be more concerned about the letter of the law than
apparent cronyism.
The mayor has put council members and astute members of the public in an awkward
position of having to openly scrutinize this nominee's lack of experience for the head
planning position, or even an entry-level planner position, for that matter. If you vote on a
guy like this getting the top job for land use and planning, you circumvent the charter and
you discredit anyone who works their entire professional life to obtain the necessary
credentials; you make a statement that being a true expert in land use and planning is not:'.
necessary for the power and influence and pay associated with this appointment.
I urge you to delve deep into Zendo's resume, looking beyond the poor formatting,
grammar, and spelling. Note the inconsistencies with the public record. Take a virtual
stroll through the Department of Commerce and Consumer Affairs filings, and you will
find inconsistent dates and claims of administrative and general management experience,,,;'
along with plenty of delinquent filings. Let me alert you to at least one example of the
inconsistencies stated in Zendo's resume, which is now part of the public record. In his
work experience,he references himself as a"general contractor,"beginning in 2003.
Under an "achievements" section in the resume, though, he boasts receipt of his general
contracting license in 2004.
In fact, according to the RCCA Professional & Vocational Licensing Division, Zendo's
general contractor license wasn't issued until June 2005! The two different plates on the
resume are sloppy, but the fact that both stated dates are bogus is pretty appalling to now
be on the public record. Believe me, there is more, if you dig a little. Zendo doesn't
currently have, nor has he had worker's compensation insurance under his own license,
so his claim of managing people is misrepresented in his resume. (See attached

Just use all the public records available at your fingertips to properly vet this candidate
and you will see how truly unqualified and how riddled with conflicts of interest lie is for
one of the most important positions in the County of Hawaii.
The public record will reveal that, at one point in 2012, I served as a chairperson of his
political campaign. Campaign Spending Commission reports will reflect that I
contributed nearly $300 to his campaign. That's about 10 times less than Zendo

My one-time support of Zendo didn't buy ane a job, but it did result in a nomination on
the Planning Commission. I ended up declining that nomination for good reason. Suffice
it to say, I have a pretty keen understanding of the real guy behind the charm and
charisma that you might have seen. Underneath all the sweet talk is someone who simply
doesn't have the professional experience, expertise, or credentials to lead our county's
Planning Department.
Zendo is trying to tout his experience as a developer's lobbyist as sufficient. But the debts
he owes, being paid by people to skirt the law and find loopholes, will be the price that
we taxpayers will have to pay with him as planning director. The conflicts of interest with
current planning applications, the ire that he and his cronies have created on the west side
trying to shove a proposed development down the throats of a community exasperated
with lack of infrastructure and proper developer conditions for the public good all of
that should be cause for alarm for council members who seek to preserve, not to exploit,
our quality of life on this island.
Zendo was elected for the 2012-2014 Council term, and it's a wonder why he didn't serve
more than one term. His campaign slogan, "from Puna for Puna," didn't translate into any
true representation or advocacy for Puna. In fact, he was a deadbeat who ghosted his
constituency and proved loyal to the power brokers who contributed to his campaign. I
urge the Council to look more closely at those two years on the Council and ascertain
that, contrary to what Kern indicates on his resume, he didn't "create and write" much of
his own legislation at all. And he himself did not"employ" the two staff members that
aided him in his district work.
Semantics matter. So do grammar and spelling. lt's okay to spell archaeology wrong on
your resume if you are a rookie. But when you tout yourself as an expert on land use and
planning who seeks to be paid upwards of$150,000 per year to lead one of the most
important departments in this County, with ramifications of decisions to last generations,
the spelling error should be a red flag.
When you claim to have employed or managed employees, but the public record and
RCCA specifically indicate otherwise, that should sound some alarm bells. Council
members, I hope you will do what Mitch and his mysterious interview panel should have
done: question Zendo and seek out the State of Hawaii's records to corroborate some of
his resume claims!
Just Zendo's experience working with appointed Council aides begs some follow-up.
You should be asking, what happened to his first Council aide and legislative aide? The
latter,will tell you that she was uncomfortable with his acceptance of gifts and the lack of
proper reporting of them. Zendo thrives on making behind-closed-door deals,
schmoozing, and cronyism. Ask him, why did he opt for only two years on the County
Council?

And what has been going on since his single Council term? If his embellished resume
offers any real indication, it is that he is driven by money and that his limited community
volunteerism and involvement happens around the time that he is about to make a
political move. He has no real interest in serving the public, only making money and
using his political power and influence toward that endeavor.
Zendo has no real planning experience, training, or education. Look at his educational
background stated on his resume and his own biography posted online. In 10th grade, he
vacated Pahoa High and Intermediate School to be home-schooled. His only education
beyond that is he attended a 2010 planning conference?
How can someone who purports to be a land-use and planning expert claim one
conference 10 years ago as the sole source of his related education? This is an insult to
the true professionals who perennially seek out trainings, workshops, PD credit, and
higher education to be progressively more proficient in their fields.
Zendo has worked for developers, not for any of the County of Hawaii's planning
principles. (See attached American Planning Association's Planning Principles.)
The fact that he essentially lobbied for developers and anyone seeking representation to
circumvent the existing law doesn't translate into any positive planning experience.
Do you want a Planning director who takes kickbacks? Do you want the County facing
lawsuits as a result of his kickbacks and conflicts? How about a guy that has been
frequently unreachable for comment or always in a rush to end a meeting he chaired?
How about a guy who uses the police and prosecutors as his political pawn to settle a
score? That's Zendo for you.
For the public too busy to delve into the details, I'd like you to be aware that this
individual who I can personally attest to being vindictive, who is riddled with conflicts of
interest, who is grossly unqualified to lead this planning department, is currently on the
County of Hawaii's payroll, before Council approval!
Turns out, that's a standard practice in the County of Hawaii that I would hope that
council members will rectify—because it sure makes it look like everything is set up for
you all to rubber-stamp the mayor's nominees and this poor choice for the Planning
Department.
Decently published public notices advertised Zendo as the Planning director, as if this is a
done deal, without Council approval. The advertisements should have stated that he is
the acting Planning Director. (See attached public notice from the West Hawaii Today.)
Either those public notices should be negated for their false advertising, or there is a
question as to the public benefit of our council members voting on the mayor's
nomination if it's just to rubber-stamp a done deal. Please look into this and make the
necessary changes, because we shouldn't be paying someone a salary or their medical
benefits if they aren't officially appointed.

In late November, Mitch Roth, as mayor-elect came before the Lower Puna Rising group
that I'm involved with and presumptuously introduced Ikaika Rodenhurst as the Public
Works director and Zendo as the planning director. This was further evidence for me that
this appears to be a done deal without your consideration and deliberation.

At that Lower Puna Rising meeting, what was most interesting to me, beyond the
introductions, was that, when called on to say something to us, Zendo told us he didn't
have much to say. How could someone seeking the Planning director nomination sit in on
a 40-minute slide show detailing a community's efforts to rebuild on their lava-inundated
neighborhoods and not have much to say? The writing should be on the wall that he will
do as much for us as the Planning director as he did as a council member: absolutely
nothing.

I'd like to remind council members that your jobs aren't to rubberstamp the mayor's
cabinet picks or any of his initiatives, for that matter. The people's branch of government
is meant to provide the checks and balances that are much needed to ensure our
democracy.

Please senitinize this nominee and see how grossly unqualified and potentially
detrimental that his proposed appointment could be for us all. Do some digging into his
background, beyond his manufactured sales pitch of a resume. Don't be his pawn. Look
at Mitch's Campaign Spending Commission reports and find that Zendo contributed
heavily, along with his development cronies seeking to further exploit the west side. It is
gross how people think they can buy their projects and their jobs. Honestly, I think your
constituency is sick and tired of these kinds of politics. Prove to them that you aren't that
kind of politician to vote for an unqualified nominee, simply for the fact that he is
referred to as "Mitch's friend," or even your friend. Resist cronyism.
