Your Committee on Planning, to which was referred Bill No. 12, reports as follows:
Bill 12, introduced by Committee Chair Ashley L. Kierkiewicz by request, amends Chapter 25,
Article 1, Article 2, Article 4, Article 5, and Article 7 of the Hawaii County Code 1983 (2016 Edition,
as Amended), relating to definitions, use permit requirements, parking requirements, and zoning district
regulations for medical clinics and massage, acupuncture, chiropractic and other similar health service
facilities.
The Leeward and Windward Planning Commissions forward favorable recommendations for this
amendment to the Zoning Code, which clarifies the definition of medical clinics and personal services
establishments and to identify zoning districts where such facilities would require a Use Permit.
Planning Director Zendo Kern shared that Bill 12 updates Chapter 25 to include what has become
mainstream health services such as massage, acupuncture, and chiropractic care that were not previously
specified in the definition of medical clinics.
Committee Member Matt Kaneali`i-Kleinfelder expressed that his constituents have been asking for a
similar change. He asked if a medical clinic could be on agricultural zoned land through special use
permits according to State Code to which Director Kern replied, "yes." Director Kern then explained
that special use permits have a very broad scope,whereas regular use permits are much more strict.
Committee Member Tim Richards noted that the definition of medical clinics is not species-specific and
brought up a section that refers to veterinary establishments. Mr. Richards then asked if a veterinary
could be considered "medical"under the proposed changes. Deputy Director Jeff Darrow responded that
uses not listed under the permitted uses are prohibited, but there is a veterinary establishment in the
Code.

The vote was then taken on the motion to move this measure to Council with a favorable
recommendation and passed with 9 "ayes."
Your Committee on Planning is in accord with the purpose and intent of Bill 12, and recommends its
passage on first reading.
