Dear Council Members:
Although my wife and I previously submitted testimony to you when sitting as the Planning Committee in
opposition to the nomination of Zendo Kern for Planning Director, we believe it important to again note our
objections. As a retired attorney, I strongly agree with those of you who maintain that he does not satisfy
the requirements for the position that are clearly set forth in the County Charter, and further, that the many
conflicts of interest that will inevitably arise will severely reduce any value he might bring to the office. His
required recusals will inevitably affect Planning Department staff, who might, to gain favor, make errors in
judgment that will influence Department decisions.
I should note that my wife and I strongly supported Mayor Roth in his election campaign, and that our
opposition to the nomination of Mr. Kern for this position is based solely on the objections and concerns
noted above. There should be no question that the Planning Director satisfies the Charter requirements
and that potential conflicts of interest are at a minimal level. Neither is the case with respect to Mr. Kern.
