Please accept my brief comments regarding your review and final vote concerning Mr. Kern's nomination /
appointment to our Planning Director position.
Mr. Kern asked for informal advisory opinion regarding potential conflicts of interest related to his potential
appointment to Planning Director.
While you may well see many possible conflicts of interest and need for recusal, I believe that you have an
even more fundamental responsibility to address and advise Mr. Kern that he does not currently meet the clearly
stipulated qualification requirements established and published for this position.
As published in the Tribune-Herald:
"The charter requires either a degree plus three years experience or five years experience, with
three years experience in an administrative capacity."
Please do not let the (legal) requirements of this position to be obscured by the secondary
matter of conflicts of interest that could arise if his appointment were to proceed (in spite of the
simple fact that Mr Kern does not meet the established qualifications required to be appointed
or confirmed.)
I believe that you would best serve our County Government and constituency by seeking a
candidate who meets the qualification requirements for this important position - and
advising our new Mayor regarding this most fundamental and primary consideration and
disqualifying factor.
