Re:Zendo Kern
Aloha Council Members:
I, like others who have testified previously, am a resident and homeowner in agriculturally
zoned Kohaia Ranch. We value our rural, quiet community and have experienced first hand
the adverse effects and disruption to our peaceful neighborhood caused by STVR's that are
predominantly owned by off-site, off-island people interested mainly in personal monetary
gain.
I am writing to you to convey my strong opposition to the appointment of Zendo Kern to the
position of Planning Director of Hawaii County. I feel that one of the most important and
significant pieces of legislation credited to the Planning Commission and to the Hawaii County
Council over the last several years was the passage and implementation of Ordinance 18-114
regulating STVR's.',. The Planning Commission has been directed to fulfill the implementation
and enforcement of 18-114. In my opinion Zendo Kern would be strongly conflicted in the
position of Planning Director in this regard because of his leading role in representing STVR
owners in their effort to circumvent 18-114, particularly as the law relates to the legality of
STVR's on agricultural zoned lands established after June 4, 1976. The legal challenge was
heard by the Land Use Commission last year, who unanimously upheld 18-114.
For Zendo Kern to suggest that he can simply erase his history of enabling clients who opposed
18-114 is not credible. Furthermore, it has become clear from previous testimony and
documents submitted by him,that Zendo Kern lacks the education and formal training
necessary to fulfill the requirements for the position of Planning Director.
I strongly urge the County Council to vote against the appointment of Zendo Kern as Planning
Director.
